In accordance with the Freedom of Information Act 2016, I apply for access to documents held by the Commission relating to the requirements, design, implementation, and security of electronic voting for the 2024 legislative assembly election.

I ask that the documents be supplied to me in electronic form by reply email to this address.

Disclosure of the information requested is in the public interest due to:
- the general public interest in maintaining election integrity and confidence in the results of elections;
- the general public interest in maintaining confidence in the security of Australian government information systems in light of increasing domestic and foreign cybersecurity threats; and
- the specific interest of the computer security research community in security vulnerabilities in electronic voting systems, including EVACS, the NSW iVote system, and similar overseas systems, which have been formally studied by academic researchers and covered in technology industry media.

THIRD PARTY CONSULTATION UNDER THE FREEDOM OF INFORMATION ACT 2016

I refer to your access application under the Freedom of Information Act 2016 (FOI Act), received by Elections ACT on 9 May 2024.

I am writing to tell you that we have identified information relevant to your application that concerns the affairs of a third party. This information is expected to be of concern to the third party because it relates to their personal or business affairs, or the affairs of a government or government agency. Under section 38 of the FOI Act, we are required to consult with the third party before making a decision on the release of this information.

The decision-maker will take into account any comments we receive from the third party. However, the final decision on whether to grant you access to the information requested rests with the decision-maker.

Under section 40 (1) of the FOI Act, we must respond to your application within 30 working days of receipt, not 20 working days as previously advised. I apologise for the administrative error in my acknowledgement email dated 23 May (below). Section 40 (2) provides for an additional 15 working days in order to allow us to consult with a third party.

Therefore a decision on your access application is now due on 15 July 2024.

Thanks for your email.

I confirm that these documents will be published on our disclosure log between 3-10 days from the date of decision, in accordance with s28(4) of the FOI Act. That is between 18 and 27 July.

In relation to EACTFOI-20240509-01, the documents were published on Monday 8 July. Subsequently our new website went live, and it looks like the FOI page did not have the latest version of the disclosure log. Thanks for pointing that out, this has now been corrected.
