Corruption prevention and education / Operation Kingscliff

Dear National Anti-Corruption Commission,

I make this access application under the Freedom of Information Act 1982 (Cth).

Part 1

In the 2023-24 annual report of the NACC, the Commission noted (https://www.transparency.gov.au/publicat...

“In referrals received and investigations conducted during 2023-24, the Commission observed both a perception and (to a lesser extent) actuality of corrupt conduct in 3 dominant domains in the Commonwealth public sector:

• procurement
• recruitment and promotion
• the public/private interface.”

Under the FOI Act, I request any and all corruption prevention and education documents prepared by the NACC in respect of recruitment and promotion in the Australian Public Service.

Part 2

At the 22 November 2024 hearing of the Parliamentary Joint Committee on the National Anti-Corruption Commission, the Commissioner of the NACC noted the following:

“Of our 29 current investigations, six relate to former or current parliamentarians, three relate to former or current parliamentary staffer, five relate to contractors or consultants, seven to senior executive officials and eight relate to law enforcement officials. Eight involve procurement, one involves recruitment, four involved corrupt conduct at the border, four involve law enforcement misconduct and three involve grant schemes … There are two that I will mention.

The first is Operation Kingscliff, which involved an investigation into whether a senior executive service official facilitated the transfer of the partner of a close relative from another agency to a position within the official's department for the benefit of that person and the close relative. The department made a mandatory referral to the commission. The commission opened an investigation, as it was satisfied that, if established, the conduct could substitute an abuse of office and, having regard to the seniority of the official and the nature of the conduct, that it could be serious. Using compulsory processes, we obtained and examined the documentary record of the recruitment and communications between the person of interest, the relative and others. There was a comprehensive examination of departmental records, the use of digital forensic techniques and comprehensive private hearings in which witnesses, including the POI and the relative were examined on oath to elicit the facts. The POI has since resigned.”

Under the FOI Act, I request a copy of any and all final reports (be it an investigation report (as defined under the NACC Act), a protected information report (as defined under the NACC Act), or otherwise) into Operation Kingscliff.

My response is as follows:

I will limit the scope of my request to both:

a) the copy of the first presentation; and
b) the latest copy of the presentation.

I would like both copies so that any evolution in the training is apparent.

I would also like a list of the names and date where the presentations were given also.
