A 30-day statutory period for processing your request commenced from 11
August 2024, in accordance with section 15(5)(b) of the FOI Act. Therefore
the due date for a decision on access is 9 September 2024.
 
Extension of time request
We have undertaken preliminary searches and have been informed that our
Technical advisory branch is currently experiencing a high volume of
document requests, which may result in potential delays in fulfilling your
request within the legislative 30-day timeframe. I am therefore seeking
your agreement to a 15-day extension of time under section 15AA of the FOI
Act. If you agree to this extension, the new due date for us to make a
decision on your request will be 24 September 2024. Please let us know
whether you agree by 22/08/2024.
 
This period may be extended if we need to consult with third parties or
for other reasons. We will advise you if this happens.

The NDIA do have to legally complete the request even though they are late. And half their work has already been done! They have all of the previously released documents on hand and ready to go, they just need to finalise the last 6... no good excuse to be taking any longer.

The strategy that has worked for me is to send them a message every second day politely reminding them that they have missed the legal deadline. They will get back to you haha, at some point ignoring you becomes more inconvenient than doing their job.

Hi Sally – I'm glad they finally sent these!

The NDIA have said in the decision notice that the documents…
- Brain Training for ASD
- Ratios of direct support
- Uninterrupted Power Supply
….don’t exist, but “Ratios of direct support” has already been released under FOI 24/25-0013… so clearly it DOES exist.

Their wording makes it sound like they accidentally combined the titles and searched for “Brain Training for ASD Ratios of direct support” as one document… which is probably the issue haha.

It might be worth just sending a reply to their decision email here and asking them to clarify that they conducted a search for the document titled “Brain Training for ASD” and not, “Brain Training for ASD Ratios of direct support” as they have written in the decision notice. And also mention “Ratios of direct support” clearly does exist and has been released as FOI 24/25-0013, so their statement that it doesn’t exist is incorrect.

They might tell you that you need to put in a new request for it, but if you are lucky they will revise the decision. What a mess haha.
