Of particular interest are communications regarding the coverage of the NBN on the political discussion program, "Q&A", and any directives, instructions, or requests the Minister or his staff gave or made to the ABC regarding their coverage of this issue.

My request for information is made under the Freedom of Information Act. Any documents which you would like to produce can be sent electronically.

I am seeking any correspondence, email, written or otherwise, made between the Federal Communications Minister, Malcolm Turnbull, and/or his staff with anyone from the ABC, specifically regarding the topic of the NBN. I would limit my request to documents to the period from the last Federal Election to today.

I have just clarified my request and hopefully provided enough detail for the information to be provided.

You noted in my other post that the communication has to show that it is a request under the FOI Act.

Just thought I'd let you know that the way RightToKnow's system appears to work is that when the request is sent (in email format), the subject of the message includes this detail.

It might be an idea for the site to however include this info in the template for requests as they do with the greeting and signoff as well.

I refer to your correspondence received by the Department on 3 May 2014
seeking access under the Freedom of Information Act 1982 (the FOI Act),
to:

 

‘Any correspondence, email, written or otherwise, made between the Federal
Communications Minister, Malcolm Turnbull, and/or his staff with the ABC,
specifically regarding the NBN.

 

Of particular interest are communications regarding the coverage of the
NBN on the political discussion program, "Q&A", and any directives,
instructions, or requests the Minister or his staff gave or made to the
ABC regarding their coverage of this issue’.

 

On 9 May 2014, you further refined the scope of your request to the
following:

 

‘I am seeking any correspondence, email, written or otherwise, made
between the Federal Communications Minister, Malcolm Turnbull, and/or his
staff with anyone from the ABC, specifically regarding the topic of the
NBN. I would limit my request to documents to the period from the last
Federal Election to today.

 

To be more specific, I seek documents which relate to the ABC Program,
"Q&A", and any directives, instructions, or requests the Minister or his
staff  gave or made to the ABC regarding their coverage of this issue’.

 

The statutory period for processing your request is initially 30 days,
which commenced from the date it was received.

 

Please note that processing charges may be imposed.  You will be advised
of any charges in relation to your request.

 

Consultation with Third Parties

 

In accordance with section 27 of the FOI Act, it is necessary to consult
with third parties concerning the release of documents containing
information about their business affairs.

 

While subsection 15(5) of the FOI Act sets a 30-day time limit for a
decision on access to documents, subsection 15(6) provides a 30-day
extension for the consultation process outlined above.  Accordingly, the
time limit for processing your request is now 60 days, and the new due
date for a decision on access is Friday 4 July 2014.

 

Information Publication Scheme

 

In accordance with section 11C of the FOI Act, where the Department gives
access to a document under section 11A of the FOI Act, the Department must
publish that information on its website within 10 working days after the
day an applicant is given access to the documents.

for processing your request has been extended accordingly.
