ART decisions which mention Applied Behavior Analysis
Dear Administrative Review Tribunal,
The Administrative Review Tribunal (ART) commenced operations on 14 October 2024.
Please provide copies of all ART decisions made since 14 October 2024 which include the phrase "Applied Behaviour Analysis".
I seek copies of all such decisions, regardless of whether they have been published or withheld from publication.
Yours faithfully,
David Wright
OFFICIAL
Good afternoon Mr Wright
I refer to your FOI request lodged with the Administrative Review Tribunal (ART) on 10 February 2025.
In our preliminary searches, we have been advised that we are unable to conduct a search for the words or phrases “applied behaviour analysis” in decision records, and in doing so would require a manual search through all decisions issued during the period you specified in your FOI request, being since 14 October 2024 until 10 February 2025.
The term “applied behaviour analysis” appears to be part of the NDIS jurisdictional area of the ART and as such, we are seeking your agreement to refine the scope to “Copies of all ART decisions in the NDIS jurisdictional area finalised by hearing” made since 14 October 2024 which include the phrase “applied behaviour analysis regardless of whether they have been published or withheld from publication”.
Please note that if you do agree to refine the scope, the Tribunal is still obliged to consider any documents we locate in line with the exemptions of the FOI Act.
We would appreciate a response by 20 February 2025 , if we do not hear from you by that date, we will process your request on the original scope.
Kind regards
Tracy L
