Good afternoon
I refer to your email below to the Department of the Premier and Cabinet
requesting information under the Freedom of Information Act 1992 (WA) (FOI
Act).
Your correspondence can not be accepted as a valid FOI Application in
accordance with section 12 of the FOI Act. Section 12(1) of the Act states
that for an application to be valid, the access application has to:
(a) be in writing;
(b) give enough information to enable the requested documents to be
identified;
(c) give an address in Australia to which notices under this Act can be
sent;
(d) give any other information or details required under the regulations;
(e) be lodged at an office of the agency with any application fee payable
under the regulations.
At this point, your application has not been accepted by this agency as it
does not comply with the requirements of section 12(1)(c) and (e) of the
FOI Act. Please note that until your application complies with section 12
of the FOI Act, your application remains an invalid application and
cannot be processed by the agency.
You must include an Australian postal address in order to receive notices
and the $30 application fee (section 4, Freedom of Information Regulations
1993). Applications fee can be paid by cheque or money order made payable
to "Department of the Premier and Cabinet”. Alternatively you have the
option of using the application form (attached) to lodge your FOI
application and make electronic payment of the fee by credit card, by
simply holding down the ‘ctrl’ key and clicking on the Bpoint icon (
[1][IMG]).
If we do not receive the relevant information and application fee by
Friday 21 May 2021, we will consider this application withdrawn.
Many thanks
Susan Boath
