Request for information about contract cheating
Dear Tertiary Education Quality and Standards Agency,
We’re doing a news story about the contract cheating in universities.
Could you please send through the relevant policies, procedures and documents which address contract cheating? And the relevant reports about how universities try to minimise student misconduct after the MyMaster case?
If possible, please treat this as an administrative/ informal request. Otherwise please proceed with my request as a formal information request under the Act.
Yours faithfully,
anonymous
Dear anonymous,
Thank you for your request. In order to process it, we require some
clarification about the specific documents you are seeking. You have
requested:
- relevant policies, procedures and documents which address contract
cheating
- relevant reports about how universities try to minimise student
misconduct after the MyMaster case.
In relation to the first part of your request, it is not clear whether you
are seeking policies, procedures and documents of individual universities
(or higher education providers more generally) which address contract
cheating which TEQSA may be in possession of, or whether you are referring
to internal policies, procedures and documents created by TEQSA.
Similarly, in relation to the second part of your request, it is not clear
whether you are seeking reports received by TEQSA from universities in
relation to the MyMaster case, or whether you are seeking reports prepared
by TEQSA following the receipt of information received from universities
about that issue.
Once the scope of your request is clear, we can make a judgement about
whether it is appropriate to deal with your request administratively or
under the FOI Act.
Kind regards,
TEQSA FOI

In my opinion, the agency has managed this request exceptionally well. The decision letter could be an example for an agency like the Department of Veterans Affairs or the Department of Human Services. The officer has attempted to discuss the request with the applicant. When the applicant has not responded, the officer has decided that this should only affect a part of the application and not all of it. The officer has then processed the remainder of the application and provided documents to the applicant.
There is a question. Was ALL the requested information sent, or only SOME of the requested information. Legally, part of the appliant's original request is deemed to have been withdrawn, so it is as if the applicant never made the request. However, some of the remaining information was also not provided, so I have said that it was only a partially successful request.
