Dear Mr Copper-Stout
I refer to your request for access to documents under the Freedom of
Information Act 1982 (FOI Act) regarding:
o Emails, letters, meeting notes or phone call notes relating to the
making of the Census and Statistics (Statistical Information)
Direction 2017 by the Treasurer; and
o The composition of the ABS Taskforce (without individual names where
required) delivering the survey.
Partial Transfer of Request
I am writing to tell you that I have transferred part of your request to
the Treasury. Under section 16(1) of the FOI Act, I am able to transfer a
request if the requested documents are not in the possession of the ABS,
but in the possession of another agency or if the subject matter of the
document is more closely connected with the functions of another agency.
Accordingly, on 22 August 2017 I transferred the part of your request
which relates to 'emails, letters, meeting notes or phone call notes
relating to the making of the Census and Statistics (Statistical
Information) Direction 2017 by the Treasurer' to the Treasury which has
possession of the requested documents and whose functions are more closely
connected to the subject area. The ABS will continue to process the
remaining part of your request.
We received your request on the 10 August 2017 and the 30 day statutory
period for processing your request commenced from the day after that date.
The Treasury Department will treat your request as though it received it
the same day that we did. You should therefore expect a decision from the
Treasury by 9 September 2017. The period of 30 days may be extended if the
Treasury needs to consult third parties or for other reasons. They will
advise you if this happens.
Further Information pertaining to rest of Request
In regards to the second part of your request pertaining to the
composition of the ABS Taskforce delivering the survey, given the timing
of the request, the Taskforce wasn't fully formed and therefore any
documents relating to it do not reflect it's current composition.
The current composition of the Taskforce was provided in the
Organisational Arrangements of the ABS' submission to the Finance and
Public Administration Reference Committee in the public hearing into the
Arrangements for the postal survey, on Thursday 17 August 2017.
I have provided a link to this submission here for your reference:

Technically the request was refused under s 15AC (Decision not made on request within time—deemed refusal) but I think that maybe the agency is still processing the request. The applicant made a follow-up but there is no more information. I have marked the request to show that it is not final.
