Section 22 of the FOI Act allows an Agency to redact information from
documents if that information would reasonably be regarded as irrelevant

Given the nature of your request, it does not seem that NDIA staff
members’ surnames and contact details would be relevant to you. Can you

Processing Timeframes
In accordance with section 15(5)(b) of the FOI Act, a 30-day statutory
period for processing your request commenced from 12 September 2024. This
30-day period expires on 11 October 2024.
The 30-day period can be extended in a number of ways, including with your

Unfortunately, it is currently taking us a little longer than 30 days to

We have conducted a preliminary analysis of the scope of your request and
in my assessment, this could potentially include a large number of
documents that may be relevant to your request.
I refer to your previous request FOI 23/24-0833 in which you have sought
copies of documents held by the National Disability Insurance Agency
(NDIA), within the date range 31 January 2023 to 31 January 2024.
Therefore, could I please ask that you consider revising the scope of this
request for a date range as follows:
· Documents from 1 February 2024 to the date of this request.
As such, your request remains broad in scope as it is currently worded.
We have not yet consulted with relevant NDIA staff, including staff who
are knowledgeable about how to conduct searches of the NDIA’s systems and
who could be expected to conduct preliminary searches using all reasonable

Your reference to FOI 23/24-0833 (submitted 31/1/2024) has little relevance. In relation to that specific FoI request, I received an email dated 9/4/2024 that stated:
I anticipate both requests will be finalised and the respective decisions sent to you no later than COB
Monday 22 April 2024.
The latest email I received 13/9/2024 relating to FOI 23/24-0833 includes ...
Firstly, I apologise for the significant and ongoing delays. I am continuing to process your matter. I have identified that your request includes documents which contain the business information of third parties. As such, I am conducting a consultation with those third parties to ascertain if they have any objections to the release of the documents.
Maybe I'll get another update before the end of the calendar year.
Clearly, reducing the date range for the request did not deliver a timely outcome. All that happens is your response is delayed which means you and the NDIA avoid the risk of having to do an internal review.
The NDIA's Autism Advisory Group has been going longer than the government's development process for the National Autism Strategy. There is no evidence of any significant number of documents or information held by the NDIA that relate to the National Autism Strategy. Your email does not indicate that you have even attempted a simple search for information that relates to this specific subject. You claim that "your request remains broad in scope"; I dispute that since it is specific to information the NDIS holds relating ONLY to the National Autism Strategy. Please focus on what I requested.

divert the agency's resources from its other operations. Therefore, could
I please ask that you withdraw parts of the scope related to Stage 2 and
confirm that these parts be processed as a new FOI request.
This will enable us to manage your FOI request more effectively, assist in
negotiating a manageable scope to avoid a practical refusal, and ensure
the timely provision of the decision and documents for Stage 1.

I note your original proposal (29/10/2024) for a staged approach indicated in relation to stage 1

You also wrote:

You refer to my email dated 2/11/2024 agreeing to a staged approach and a 30-day extension to Stage 1 (though I suspect that's a typo and I intended to provide a 30-day extension for Stage 2). I believe a 30-day extension to stage 1 would mean 1/12/2024 at the latest - I'm not sure what date that extension would be considered as starting from. In any case, it seems that Stage 1 is now overdue.
You fail to mention or even acknowledge my response sent to you dated 16/11/2024. My response proposed a process for managing the excessive items you claim to have come across.
You refer to an OIAC "the Office of the Australia Information Commissioner (OAIC) grant[ing you] a 30-day extension of time under section 15AB of the FOI Act, making 10 December 2024 the new date to provide you with a decision on access". I can only guess that this is some other process in relation to the proposed stage 2 of your staged approach.
You write

The revised scope (proposed in my email 16/11/2024) involve just 582 lines of text at the initial stage of stage 2. I cannot see how reviewing this amount of information "would substantially and unreasonably divert the agency's resources from its other operations". I reject your claim.
In any case, you proposed a 2 stage approach. Dropping stage 2 means that is is not a staged approach as you suggested. Surely, it's too late now to require this change; you had plenty of opportunity to raise and discuss the issue before now. So I am definitely not "happy for us to proceed with your request as outlined above" in tyour email.

Dear foi,
I am interested in the officials whose responsibilities and actions are
delivering the National Autism Strategy. For people at the SES level, I
feel it is appropriate that they are identified either by name or by the
role/position title they are acting in. If their SES position is clear, I
do not need their name. I do not need the names of people at lower levels
... I hope their position is identfied.

Freedom of Information Request: Acknowledgement
Thank you for your request of 11 September 2024, made under the Freedom of
Information Act 1982 (FOI Act), for copies of documents held by the
National Disability Insurance Agency (NDIA).
Scope of your Request
You have requested access to:
“...all information held by the NDIA relating to the National Autism
Strategy including, but not limited to:
1. communication with and information provided to the National Autism
Strategy Oversight/Committee/Council and/or its working groups, 2.
communication with and information provided to staff or officials in the
Department of Social Security, 3. information given to politicians or
parliamentary officials, 4. information and records held within the NDIA,
and 5. relevant information received by the NDIA...”
Irrelevant Information
Section 22 of the FOI Act allows an Agency to redact information from
documents if that information would reasonably be regarded as irrelevant
to a request for access.
Given the nature of your request, it does not seem that NDIA staff
members’ surnames and contact details would be relevant to you. Can you
please send me a reply email confirming that such details are irrelevant
to your request for access?
Processing Timeframes
In accordance with section 15(5)(b) of the FOI Act, a 30-day statutory
period for processing your request commenced from 12 September 2024. This
30-day period expires on 11 October 2024.
The 30-day period can be extended in a number of ways, including with your
agreement.
Unfortunately, it is currently taking us a little longer than 30 days to
process FOI requests. I am therefore seeking your agreement to a 30-day
extension of time under section 15AA of the FOI Act. If you agree to this
extension, the new due date for us to decide on your request will be 11
November 2024.
If you do not agree and we are unable to process your request within the
30-day period expiring on 11 October 2024, we will be deemed to have
refused your request and you will not have a right to seek internal review
of that decision. You will, however, retain your right to external review
by the Australian Information Commissioner.
Please let us know if you agree by Wednesday 2 October 2024.
Disclosure Log
Subject to certain exceptions, documents released under the FOI Act will
be published on the NDIA’s disclosure log located on our website.
If you have any concerns about the publication of the documents you have

If you don't agree they won't provide you with the stage 1 documents either, they just refuse the whole request. This just happened with my replacements supports request. Frustratingly your best bet is to just agree but express your dissatisfaction in having to do so, and then put in a new request for the 2nd half.
