Good evening Matt,

I refer to your request received by the Department of Health and Aged Care
(the department) for access to documents under the Freedom of Information
Act 1982 (FOI Act). You have requested access to:

A list of all influencers who have been engaged to spread anti-vape
messages in the media and online.

We have consulted with the relevant area of the department who have
advised that while the department has engaged with influencers regarding
the Youth Vaping Education Campaign, the department does not hold a
discrete document that contains this information.

Paragraph 2.42 of the FOI Guidelines provides that the FOI Act does not
require an agency or minister to create a new document in response to an
FOI request except in the limited circumstances set out in section 17 of
the FOI Act. In this instance, the department is not able to produce a
written document containing the information by using a ‘computer or other
equipment that is ordinarily available’ to the agency for retrieving or
collating stored information (s 17(1)(c)(i)).

However, if you are agreeable, the department can release this information
to you administratively (outside of the FOI Act).

We would be grateful if you could confirm if you would like to withdraw
your FOI request and proceed with an administrative release.

If the department does not hear from you by close of business 26 July 2024
we will proceed with your request in its current form.

In addition to the above please note, further information regarding the
influencers engaged by the department can be found on the department’s
website at the link below:
