You have requested “a copy of the audio of the original transmission
referred to in this report [link provided] which would have aired on JJJ
Breakfast with Tom and Alex sometime in the week beginning August 6,
2012.”
The online article you provided references a Breakfast radio show on
triple j that aired on 9 August 2012.
We are in the process of searching for this audio. Under the Commonwealth
Freedom of Information Act (1982), the ABC is exempt from the FOI regime
in relation to its program material, this includes programs that are
broadcast on air.
Would you kindly advise whether you wish to proceed to a formal decision
letter about this exemption which requires the ABC to refuse access to the
audio under FOI.
In the alternative, if the ABC has a copy of this episode, there may be
provision for you to purchase it. Is this something you would be
interested in?

Interested to see how the ABC processes this request… As technically the information you’re asking for is exempt as it relates to program material. That doesn’t stop the ABC from supplying the information however.
