Investigation of Crown Casino
Dear ACLEI FOI team,
I would like to request under the Freedom of Information Act documents from the government to ACLEI regarding the investigation into Crown Casino in relation to a series of allegations about the company's conduct.
I am seeking specifically:
1. Documents from the government to ACLEI requesting ACLEI to investigate the allegations made about Crown Casino.
2. My understanding is that ACLEI's jurisdiction is limited to law enforcement (and related) agencies and would also seek any relevant documents (if applicable) which expands the scope and jurisdiction to allow ACLEI to include government agencies, politicians and other relevant persons or organisations.
Yours faithfully,
Evelyn Doyle

Dear Ms Doyle
I am writing to notify you that your FOI request has been received by the
Australian Commission for Law Enforcement Integrity (ACLEI). Your request
was received by email on 8 August 2019. Key information relating to your
request is outlined below.
Consultation regarding request
Your request is as follows:
1. Documents from the government to ACLEI requesting ACLEI to
investigate the allegations made about Crown Casino.
2. My understanding is that ACLEI's jurisdiction is limited to law
enforcement (and related) agencies and would also seek any relevant
documents (if applicable) which expands the scope and jurisdiction to
allow ACLEI to include government agencies, politicians and other relevant
persons or organisations.
I am seeking clarification about the second part of your request. Could
you please elaborate on what you mean by documents which ‘expand’ the
scope and jurisdiction (etc.)? For context, the Integrity Commissioner’s
jurisdiction to deal with corruption issues is set out in the [1]Law
Enforcement Integrity Commissioner Act 2006 (LEIC Act). No amendments have
been made since the referral by the Attorney-General to ‘expand’ that
jurisdiction.
Could you please therefore provide further information about what you mean
by documents that ‘expand’ the Commissioner’s jurisdiction, or
alternatively withdraw this part of the request.
Timeframes
Under s 15(5)(a) of the FOI Act, ACLEI must notify you that your request has
been received as soon as practicable and no later than 14 days after receipt.
This is a notice of receipt pursuant to s 15(5)(a).
Under s 15(5)(b) of the FOI Act, ACLEI must notify you of a decision in relation
to your request as soon as practicable and no later than 30 days after the day
the request was received. That date is Monday 9 September 2019.
This date may be extended in certain circumstances. ACLEI will notify as soon as
practicable if an extension is sought or if the date has been extended.
Charges
There may be a charge for processing your request. Any charge will be
assessed in accordance with the Freedom of Information (Charges)
Regulations 2019 (FOI Charges Regulations). You will be notified of any
charge for processing your request as soon as practicable.
Correspondence
Correspondence relating to your request will be sent by email to your nominated

Please advise us if you would prefer correspondence by a different method
or to a different address.

Irrelevant material
Under s 22 of the FOI Act, an agency may grant access to an edited copy of
a document in which ‘information that would reasonably be regarded as
irrelevant to the request for access’ has been deleted.
ACLEI’s policy is that personal information of public servants, such as
names and contact details, is irrelevant unless it is central to the
request. This ensures efficient processing of FOI requests.
Please advise ACLEI if you do not consider this information to be
irrelevant to your request.
Publication of information accessed through your request
ACLEI may publish information in any documents accessed through your
request on our website ([4]https://www.aclei.gov.au/).
Under s 11C of the FOI Act, an agency must publish this information
relating to documents accessed through a request within ten working days
of access being given unless an exception applies. Exceptions include
personal information and information about the business, commercial,
financial, or professional affairs about any person if it would be
unreasonable to publish the information.
Please advise ACLEI if you believe disclosure of any or part of your
personal information and/or information about your business, commercial,
financial, or professional affairs would be unreasonable.
Please let me know if you have any questions.
Kind regards,
FOI Officer

Dear ACLEI FOI,
Thank you for your correspondence seeking clarification of the second part of my FOI request.
My understanding is that ACLEI is limited to investigations of corruption within Commonwealth law enforcement agencies. To be able to investigate the conduct of Crown Casino it would be reasonable to assume that a proper investigation would include all possible participants in that corruption (not just those involved in law enforcement).
For that purpose the government might, in writing, expand the jurisdiction for the purpose of the Crown investigation to include other government agencies, politicians, other individuals or organisations (normally outside ACLEI's jurisdiction).
So to clarify, I am seeking any document, should it exist, that expands the jurisdiction as covered above. It may be included in the referral document from the government, or it might be a separate document.
It is not clear to me reading the ACLEI website whether it is able to investigate corruption outside of law enforcement.
If ACLEI is able to investigate corruption beyond law enforcement agencies, please disregard the second part of the request.
Yours sincerely,
Evelyn Doyle
