Freedom of Information Logs - FOI Request
Dear Aged Care Complaints Commissioner,
I am writing to make a request under the Freedom of Information Act for a complete copy of the departments' Freedom of Information (FOI) logs for the period 2013-2023, including any secondary departments controlled by the agency.
I request that this is provided as a document and not a simple redirect to the agency website as I am of the view that your online disclosure logs do not actively reflect your FOI requests that you have received in this period.
I would appreciate it if you could provide me with this information in an electronic format, such as a PDF or spreadsheet, if possible.
If there are any fees associated with fulfilling this request, please let me know in advance so that I can consider my options.

Thank you for your request for documents under Freedom of Information
(FOI), received by the Aged Care Quality and Safety Commission
(Commission) on 6 May 2023. We have taken your FOI request to mean, a
complete copy of the Commission's FOI disclosure log for the period
2013-2023. Is this correct?
Your email indicated that the Commission’s online disclosure log may not
reflect the total amount of FOI requests received.
The Commission is required under s11C of the Freedom of Information Act
1982 (FOI Act) to publish a disclosure log on our website. However, this
requirement does not apply to personal information about any person or
information relating to commercial, financial or professional affairs of
any person, if publication of that information would be 'unreasonable'.
The overwhelming majority of FOI requests received by the Commission
relate to this type of information. However, for each individual FOI
matter, a decision is made by the relevant Delegate relating to potential
publication of the request and any information where access to documents
has been granted. This may be why it appears the online disclosure log
does not actively reflect the total number of FOI requests received by the
Commission.
Please note that while 2022/2023 data is not yet available, the total
number of FOI requests received by the Commission is published on our
website in the Annual Report.
Given this information is already publicly available on our website, would
you be agreeable to withdrawing your FOI request? If agreed, please
provide confirmation as soon as possible.
Alternatively, is there any further information you could provide which
would help to clarify your FOI request, or our disclosure log listings?

We refer to our emails to you dated 11 May and 24 May 2023, to provide
information and seek further clarification from you in relation to your
initial email request to the Aged Care Quality and Safety Commission (the
Commission). Unfortunately we have not received any further response from
you since your initial request on 6 May 2023. We now advise that if we do
not receive any further contact from you on or before close of business on
Thursday 1 June 2023, we will have no option but to mark your FOI request
as withdrawn.
We look forward to your response, however, you would be more than welcome
to submit a new request at a later date, or to contact me if you have any
