Thank you for your email to CSIRO’s Freedom of Information Team. Your
email has been received and will be actioned as appropriate.

 

If an FOI request is valid, a decision in response to the request is due
30 days after the request is received by CSIRO on 31 October 2024. This
timeframe can be extended under the FOI Act including where third-party
consultation is required. CSIRO notifies applicants when an extension is
required.

 

If an FOI request is not valid, the 30-day timeframe does not commence.
CSIRO contacts applicants to advise them of invalidity within 21 days of
receipt of the application.

 

Charges may be imposed for processing your request pursuant to section 29
of the FOI Act. These charges are calculated by reference to the time
spent processing a request, including time spent searching and retrieving
relevant documents, preparing any documents for release, consulting and
decision- making. In the event CSIRO decides that you are liable to pay a
charge for the processing of your request, you will be notified of a
preliminary charges assessment and you will have the opportunity to
contend that the charge should not be imposed or should be reduced.

 

We would be grateful if you could please confirm via reply email, whether
you prefer documents from a specific timeframe since CSIRO issues very few
notices of charges to the FOI applicants every year.

Thank you for providing these documents. I have a couple of questions regarding their content that I hope you can clarify:

1. Document 3 refers to a notice of charge decision under section 29(8) of the FOI Act, where the charge was reduced by 50% on public interest grounds. However, I am unable to locate the original notice of charge (preliminary charge estimate) for the relevant FOI request, which is FOI2022/59. Could you please provide a copy of the initial charge estimate or explain the circumstances surrounding this request?

2. Regarding Documents 8, 9, and 10, which relate to FOI2023/32, could you confirm if my understanding of the timeline is correct?
- 26 April 2023: FOI request received.
- 23 May 2023: Preliminary estimate of a charge issued ($1,544.25).
- 24 May 2023: Applicant contends the charge estimate.
- 9 June 2023: Applicant revises the scope of their request.
- 19 June 2023: Second preliminary estimate of a charge issued ($826.33)
- 23 June 2023: Deemed affirmation of the original charge estimate ($1,544.25 -- issued on 23 May 2023).
- 26 June 2023: Deemed access refusal decision due to no decision being made within the statutory timeframe. As a result, no charges can be imposed, per sections 7(2) and 7(3) of the Charges Regulations.
- 1 August 2023: Final charge decision issued, confirming that no charges could be imposed due to the deemed refusal decision on 26 June 2023.

Your response would greatly assist my inquiry into government agencies' administration of FOI charges and their compliance with obligations under the FOI Act.

In respect of question 1, you are correct, and we apologise for this
omission and any inconvenience it has caused.

 

Attached to this email is:

 

o an amended Notice of Decision on access (with updates only to the
number of documents and pages found);
o an amended Schedule of Documents, identifying the additional documents
as ‘document 14’; and
o a copy of the additional document.

 

In respect of question 2 – The FOI Act only provides an applicant with a
right to access documents, and not information (including
explanation/interpretation of documents). However, in this case, I am
happy to confirm that your understanding of the timeframe appears to be
correct. I would just add that, although the decision was technically
deemed to be an access refusal due to the administrative
complexity/confusion that led to the lapsing of a statutory deadline (and
charges therefore not imposed), a substantive access decision was
nonetheless issued by CSIRO on 1 August 2023, in accordance with the
appropriate practice as contemplated by the FOI Guidelines.
