I refer to your request of 1 October 2024, whereby you made a request for
the following documents under the Freedom of Information Act 1982 (the FOI
Act):

Please exclude the following information:
i) Personal information of FOI applicants.
I acknowledge receipt of your request under the FOI Act. CASA received
your request on 1 October 2024 and the 30-day statutory period for
processing your request commenced from the day after that date. You should
therefore expect a decision by COB Thursday, 31 October 2024. However, the
period of 30 days may be extended if CASA needs to consult third parties
or for other reasons. CASA will advise you if this happens. Should the
timeframe be extended, you will be notified by CASA with the new due date.
Your above request has been assigned the reference number F24/30200,
please use this reference number in future correspondence relating to your
above request.
You will be notified of any charges in relation to your request as soon as
possible, before we process any requested documents or impose a final
charge. CASA’s practice is to release documents in pdf format transmitted
via email to your nominated email address. Please advise if you wish a
different communication method – additional charges may apply.
When CASA has made a decision about your FOI request, we will send you a
letter explaining our decision and your review and appeal rights.

As I wish to access only recent charge decisions, I have introduced a time frame and clarified the exclusions. I confirm the revised scope of my request as follows:

The time period for my request is from 1 July 2022 to 1 October 2024.

On 23 October 2024, you provided clarification to your scope to include:
If a preliminary charge notice or decision of a charge is sent via the
body of an email (as opposed to an email attachment) I wish to access a
copy of that email, as well as the applicant's contention reasons.
The FOI Team have been experiencing a high number of FOI requests and
shortages due to staff changes. Unfortunately, CASA has also been
experiencing an all-wide agency network issue where we are unable to
access our Microsoft applications. In order to continue processing your
request, could you please provide us an extension of time under section
15AA of the FOI Act until COB Wednesday 6 November? I sincerely apologise
for the delay.
If you could please respond to this email confirming whether you agree to
the extension of time until Wednesday 6 November by COB today (Thursday 31
October), that would be greatly appreciated. Please note that if you do
agree, the time may still be extended for various reasons. Should this
occur, I will notify you of this as soon as possible.

patience during this time.

On 23 October 2024, you provided clarification to your scope to include:
If a preliminary charge notice or decision of a charge is sent via the
body of an email (as opposed to an email attachment) I wish to access a
copy of that email, as well as the applicant's contention reasons.
On 31 October 2024, you agreed to an extension of time under section 15AA
of the FOI Act to Wednesday 6 November 2024.
CASA has been unable to make a decision under the statutory timeframes and
as a result, the outcome is a deemed refusal of your request under the FOI
Act.
The consequence of this ‘deemed refusal’ is that you have the right to
apply to the OAIC for Information Commissioner (IC) review and CASA cannot
impose a charge for access.
CASA has continued to prepare a substantive decision and statement of
reasons on your FOI request and our obligation to do so continues even if
you apply for IC review and up until any IC review of the deemed decision
is finalised.
CASA will continue to process your FOI request and prepared a decision
which will be substituted for the deemed refusal decision unless you have
already applied to the OAIC for IC review and the IC instructs CASA
otherwise.
We sincerely apologise for the errors in processing your request and the
delay in providing you with a decision regarding access.
