Disclosure Log documents 37/2019 - 39/2019

Under FOI I seek access to a copy of the documents released to FOI applicants and reflected in Disclosure Log entries 37/2019, 38/2019 and 39/2019.
The documents are not available for download from the Disclosure Log webpage.

Unfortunately there was an administrative error and the numbers 37, 38 and 39 were not used and therefore no documents were uploaded onto the disclosure log.

Dear FOI,
Thank you for revealing that there was an administrative error and the numbers 37, 38 and 39 were not used and therefore no documents were uploaded onto the disclosure log. You do not reveal the detail of the administrative error. The Disclosure Log indicates that
Nos 35 and 36 were allocated to the release of documents on 20 Dec 2019
No 40 was allocated to a release of documents on 16 Dec 2019
No 41 was allocated to a release of documents on 19 Dec 2019
No 42 was allocated to a release of documents on 2 Jan 2020
No 43 was allocated to a release of documents on 20 Nov 2019
No 44 was allocated to a release of documents on 17 Jan 2020
No 45 was allocated to a release of documents on 20 Jan 2020
No 46 was allocated to a release of documents on 5 Dec 2019
No 47 was allocated to a release of documents on 20 Mar 2020.
Whoever allocated No 40 must have had confidence that proposed Nos 37 to 39 of the Disclosure Log had been allocated to released documents not yet uploaded to the log.
The FOI Act requires agencies to publish information in a disclosure log within 10 working days after the freedom of information (FOI) applicant was 'given access' to a document.
The Agency did not meet its legal obligation in respect of the release of documents detailed at log entries 43 and 46. It seems the Disclosure Log requirements were overlooked but subsequently rectified. The circumstances raise the possibility that documents were released and allocated Nos 37 to 39 but have not yet been uploaded.
