CFD Forum compliance plan compliance documents

We're waiting for Compliance Associate to read recent responses and update the status.

Compliance Associate

Dear Australian Competition and Consumer Commission,

I am requesting documents related CMC Markets Asia Pacific Pty Ltd, GFT Global Markets UK Limited, IG Markets Limited, Australian CFD Forum Limited and
parties otherwise listed in Schedule 1 made December 2013.

In the submission a compliance plan was being developed by Ms.
Jan Redfern PSM, former senior executive of ASIC and currently part time Senior Member of the Administrative Appeals Tribunal and the Guardianship Tribunal and independent governance and regulatory compliance consultant, to assist them in relation to a proposal to establish a CFD industry body and best practice standards for the Australian CFD industry.

Please provide documents about industry best practices and compliance plans created by Jan Redfern.

Additionally documents about Trio Capital and fraud and the need John Hempton to Treasury to use only arrangements like Citco as custodian of client assets and strongly critical of the typical brokerage and clearing arrangements used by typical Hedge Funds.

Yours faithfully,

Compliance Associate

Compliance Associate

Dear FOI,

Please confirm that your refusal due to 'no documents found' includes cfd forum's requirements of member firms to safeguard customer monies. And when member firms may be excluded from 'retail' safeguards.

The cfd forum application mentioned services provided by Jan Redfern Sector Seven so all documents which describe risk controls of member firms to safeguard customer funds as well as exceptions afforded customers who may be considered 'wholesale' or sophisticated.

Yours sincerely,

Compliance Associate

Compliance Associate

Dear Australian Competition and Consumer Commission,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Australian Competition and Consumer Commission's handling of my FOI request 'CFD Forum compliance plan compliance documents'.

The CFD Forum was created to promote interests of it's members, and in their application to the ACCC listed Jan Redfern and her experience as enforcement director off ASIC, as a senior member of Australia's Administrative Appeals Tribunal and principal of compliance consulting firms AllyGroup and Sector Seven.

Her role as owner/ principal of Sector Seven and the above mentioned roles within Australia's regulatory bodies both private and public were listed. This would naturally give the general public an assurance that the compliance plan being created would provide benefits for Australian consumers so that their funds would not be at risk of loss due to fraud like those experienced by Trio Capital, which as Senior AAT member Ms Redfern was the judge for two matters. (ASIC vs Ross Tarrant & ASIC vs. Eugene Liu)

In 2011 - 2014 various documents were provided to ASIC, APRA, ATO, ACCC and AFP about the serious risks of complex derivative products.

Among these documents was then ASIC chairman Greg Medcraft's US FINRA U4 while he was employed at Soc Gen which listed Maxie Partners, a hedge fund managed by Howard Winnell as an Outside Business Activity (OBA)

Multiple documents about Fimat, Newedge, Atlantis Capital and Paradigm (owned by then senator Biden's family) and "custody" as emphasized by then Australian Treasury Secretary Ken Henry.

Due to the sensitive nature of the above I would be happy to discuss offline.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.righttoknow.org.au/request/c...

Yours faithfully,

Compliance Associate
