Dear Australian Securities and Investments Commission,

I am lodging a request for documents pursuant to the Freedom of Information Act 1982.

The documents I seek are copies of correspondence between Mr Beau Dreux from the Office of the Assistant Treasurer and ASIC on or around 8 October 2014 seeking information on behalf of Mr Michael Sukkar MP in relation to superannuation entitlements in relation to a superannuation fund that has been known as The Provident Fund, the Elders IXL Superannuation Fund and the AusBev Superannuation Fund.

This occupational pension fund was established on the 23 December 1913 in the State of South Australia. The terms of this trust were amended by the Elder Smith & Co Limited Provident Funds Act 1963 (SA).
This enactment confirms that the "authorised purpose" of this trust is to provide "pension and benefits" to certain "male officers, their wives, widows and dependants".

The documents I seek would also include, but not limited to, any explanation provided by ASIC to the Office of the Assistant Treasurer as to why these pension benefits are not being paid to qualifying male officers any why survivorship pensions are not being paid to their widows.

A document signed by the well known white-collar criminal, Ken Jarrett purports to abrogate the right of widows to receive a survivorship pension.

The documents I seek would include, but not limited to, any explanation provided by ASIC to the Office of the Assistant Treasurer as to why widows are not being paid survivorship pensions, when the only document that purports to abrogate the entitlement is signed by a well known white-collar criminal.
