AFP RAID & Litigation & Annika Smethurst
Dear Australian Broadcasting Corporation,
I am writing to request copies of documents held by the ABC that are in relation to the Raid on your offices by the AFP in July 2019.
I would like copies of all court documents that have been placed on the court file and have been made a public record.
I would like copies of the documents for all parties to the matters that have been filed in the Federal and High Court.
Yours faithfully,
Tesi
Dear Tesi,
Our apologies for taking some time to acknowledge your request – we
consulted with our internal counsel to determine where to obtain the
documents that you are seeking.
The court documents that have been filed on the public record are
available on the Federal Court website at the following link:
[1]https://www.fedcourt.gov.au/services/acc....
With regard to the High Court matter, the ABC is not a party to these
proceedings. The ABC may hold some documents relating to these
proceedings, however they would be unlikely to be released, as they may be
subject to legal professional privilege and so exempt from disclosure
under Section 42 of the FOI Act.
Documents that are on the public record for High Court proceedings are
available on the [2]High Court of Australia website. You may also wish to
contact the agencies that are party to these proceedings, namely the
[3]Australian Federal Police.
In light of the above, I would appreciate if you could let me know whether
you wish to withdraw or proceed with your application by 13 March 2020.
Kind regards,
