I refer to your correspondence received by the Department of Social
Services (Department) on 3 October 2024, in which you requested access
under the Commonwealth Freedom of Information Act 1982 (FOI Act) to:

 

• All advice or draft advice to the NDIS Minister relating to the
transitional NDIS supports rules or associated consultations between 4th
August 2024 and 2nd October 2024

• Any associated advice or draft advice to the NDIS Minister relating to
the Miscellaneous Provisions transitional rules

• All prior advice or draft advice to the NDIS Minister relating to the
development and/or policy objectives of the draft NDIS supports lists
since October 2023

 

The decision for this request is currently due on 4 November 2024. This
timeframe may be extended, for example, where the Department decides to
consult with third parties. We will inform you if this occurs.

 

Removal of certain information from the scope of your request

 

The Department is seeking your agreement to remove the following
information from the scope of your request where it is not available from
public sources:

 

o group email addresses used for internal departmental purposes;
o all personal information of members of the public;
o all personal information of non-Senior Executive Service (SES)
government staff; and
o all personal information of SES level government staff with the
exception of the names of the Department’s SES staff.

 

If you agree to the above amendment the names of the Department’s SES
staff will be released where they are present in the documents and do not
attract an exemption.

 

Could you please respond to this email by 7 October 2024 to confirm your
agreement to this change.

Thanks for your prompt response. I've responded to each point separately below – are these changes acceptable?

1. group email addresses used for internal departmental purposes;

Fine to remove.

2. all personal information of members of the public;

Fine to remove with the exception of:
• references to published Senate inquiry submissions or public evidence from witnesses
• references to feedback from reference, advisory and/or representative groups (removing individual names and any personal examples, but not general or hypothetical examples of potential negative outcomes)

3. all personal information of non-Senior Executive Service (SES) government staff;

Fine to remove names and personal information, however please leave the sections of email signatures and email addresses indicating the agency (and business area, for email signatures, but redacting roles and other details).

4. all personal information of SES level government staff with the exception of the names of the Department’s SES staff.

Can you please clarify if this will include retaining the names of NDIA SES staff given they fall within the Social Services portfolio? At a minimum, I ask that all DSS and NDIA SES names are included. If any SES from other agencies appear (e.g. Treasury), my preference is for their names to be included too.
