Validity of the office of the Queensland Government State Penalties Enforcement Registry

Misty Pickle made this Right to Information request to Queensland Office of State Revenue

This request has been closed to new correspondence from the public body. Contact us if you think it ought be re-opened.

Response to this request is long overdue. By law, under all circumstances, Queensland Office of State Revenue should have responded by now (details). You can complain by requesting an internal review.

Dear Queensland Office of State Revenue,

I require a copy of the documentation which validates the existence of the Office of the Qld Government State Penalties Enforcement Registry and the name and contact details of the current Registrar.

Yours faithfully,

Misty Pickle

Hi Misty,

The SPER was established under the State Penalties Enforcement Act 1999 which can be found here https://www.legislation.qld.gov.au/view/...

The organization chart for QLD Treasury which can be found here https://s3.treasury.qld.gov.au/files/tre... but doesn't show whether Elizabeth Goli is the Registrar or not. However, a Google Search suggests Natalie Barber is the current Registrar https://au.linkedin.com/in/natalie-barbe...

Good luck

Steph

Thanks Stephanie, I realise that the State Penalties Enforcement Act was enacted but it seems to lack having gone through the due process to be made lawful. ON the Act itself there is no commencement date which suggests no Proclamation or Royal Assent also. Im seeking to confirm or deny this fact

No worries Misty,

I can see that the date of assent was 6 December and that section 2 of the Act says 'date to be fixed by proclamation'. Assuming the proclamation occurred sometime in the 6 months after assent, it's probably going to be in the Government Gazettes for 2000.

I can see they aren't available online, and are only available on microfiche or hardcopy from the QLD Library https://www.slq.qld.gov.au/research-coll.... Hopefully Treasury can dig it up for you.

Good luck

Steph

I noticed that the assent on 6th December is on a document that SPER refers us to. Its the STATE PENALTIES
ENFORCEMENT ACT 1999 Act No. 70 of 1999
and although it contains pretty much the same info, it is not identical. The STATE PENALTIES ENFORCEMENT ACT 1999 has NOT been assented to or has a valid commencement date. I shall get onto the hunt for the Gazette tomorrow.
Thanks
Misty
