Yours faithfully,

OFFICIAL
Dear Arthur
On 3 January 2023 you sent a request to the Australian Department of the Treasury (Treasury) in the following terms: "can you please clarify that UCC1 and UCC3 are recognised in the Australian banking system or within the Australian legal system"
We are not able to process your request under the FOI Act as you are seeking information, not documents. The FOI Act allows a person to request documents.
We can further advise that even if you submit a request for documents, we will not be able to assist you. The relevant area of the Treasury undertook a document search and did not locate any documents. This was expected as the Treasury is the Australian Government’s lead economic adviser. We provide advice to the Australian Government and implement policies and programs to achieve strong and sustainable economic and fiscal outcomes for Australians.
We think the clarification you requested is likely to be legal advice on applying American commercial law in Australia. The Treasury does not provide legal advice on the application of American commercial law in Australia. We suggest you contact your legal representative.
Kind regards,
Freedom of Information Officer
The Treasury
