Dear Emily Lacey

Freedom of Information Request: Acknowledgement

Thank you for your request of 12 October 2024, made under the Freedom of
Information Act 1982 (FOI Act), for copies of documents held by the
National Disability Insurance Agency (NDIA).

Scope of your Request

You have requested access to:

“ 1. A copy of all internal NDIA "intranet" pages regarding the Technical
Advisory Branch (TAB).

2. All documents providing NDIA staff guidance on how to request advice
from the TAB.

3. All documents regarding “mandatory referral” to the TAB.

4. All “TAB checklist” documents.

5. All TAB referral/request submission templates and forms.

6. All TAB advice/report templates and forms.”

Processing Timeframes

In accordance with section 15(5)(b) of the FOI Act, a 30-day statutory
period for processing your request commenced from 13 October 2024. This
30-day period expires on 11 November 2024.

The 30-day period can be extended in a number of ways, including with your
agreement.

Unfortunately, it is currently taking us a little longer than 30 days to
process FOI requests. I am therefore seeking your agreement to a 30-day
extension of time under section 15AA of the FOI Act. If you agree to this
extension, the new due date for us to decide on your request will be 7
December 2024.

If you do not agree and we are unable to process your request within the
30-day period expiring on 11 November 2024, we will be deemed to have
refused your request and you will not have a right to seek internal review
of that decision. You will, however, retain your right to external review
by the Australian Information Commissioner.

Please let us know if you agree by 28 October 2024.

Disclosure Log

Subject to certain exceptions, documents released under the FOI Act will
be published on the NDIA’s disclosure log located on our website.

If you have any concerns about the publication of the documents you have
requested, please contact me.

Next steps

Your request will be allocated to an authorised FOI decision-maker. The
decision-maker may need to contact you to discuss a range of matters,
including refining the scope of your request.

We will contact you using the email address you have provided. Please
advise if you would prefer us to use an alternative means of contact.

In the meantime, if you have any questions or need help, please contact us
at [1][NDIA request email].

Dear National Disability Insurance Agency,

I do not give my consent for a 30 day extension. I have at least two requests in right now where I gave you a 30 day extension (so 60 days to process) and they've still ended up overdue by another 30 days on top of that. I see no meaningful benefit for me to approve an extension if you still allow that time to lapse and thus my internal review rights to expire.

Kind regards,
Emily Lacey

Dear Mykal,

The agency has had 58 days to process this request and we're coming up on a month overdue. Do you please have an update on when I can expect the documents?

Kind regards,
Emily Lacey

Dear Kate,

Thank you for providing such a thorough explanation and suggestion for a revised scope, it has been very helpful. I am happy to proceed with the scope you have suggested (1-6) with a few (hopefully easy) additions (7-9).

Revised scope:

1. A copy of the 11 main internal NDIA "intranet" pages regarding the Technical Advisory Branch (TAB).
2. Knowledge Article titled “Create a Technical Advice Case” and Intranet content on Requesting Advice page.
3. “Mandatory Advice Requests” content on Intranet Page, including any linked intranet pages.
4. TAB Checklists on Intranet page.
5. TAB referral/request submission templates and forms.
6. TAB advice/report templates and forms.
7. Knowledge Article titled “Complete the risk matrix for a technical advice case”.
8. Knowledge Article titled “Review and action returned technical advice case”.
9. Whatever main article or intranet page explains what "TAB Digest" is and how to find/use it.

Please let me know if any further consultation is required. I am happy to consider another revision to avoid the practical refusal if it is needed, as I have already waited 2 months for this request and it would be a shame for that to go to waste.

Kind regards,
Emily Lacey

Dear Kate,

Thank you – very happy to hear that we can proceed with this scope.

I'm guessing this might be the last I hear from you in 2024 – so I wanted to take a moment to say thank you to you and the rest of the FOI team for your work this year in responding to my requests, if you can pass the message on.

I think you all have finalised an impressive 14 requests for me this year (and I know not all of them have been easy haha). Please know that I am very grateful and appreciative of the effort you have all put in to make that happen. It's certainly not for nothing and has genuinely been such an important piece in helping a number of people – so, thank you.

I hope everyone has a safe and restful holiday, and a happy new years! And I'll catch you on the other side, ready to lovingly pester you all some more in 2025 haha :)

Yours sincerely,
Emily Lacey
