Dear Public Transport Victoria,

I wish to acquire documents displaying statistics regarding pedestrians struck by trains in Gippsland. I.e. the metro and/or V-Line trains between Sale and Melbourne.

Number of incidents recorded between 2008 and 2018 would be substantial.

Thanks for your message.

PTV can conduct a search for documents relevant to your request; however,
please note that under the Freedom of Information Act 1982 (Vic), a FOI
request entails an application fee of $28.90, plus copying and search
charges. The links below provides some additional information on FOI

The application fee can be paid by cheque or money order (made payable to
"Public Transport Victoria") posted to the address below.

FOI fees and charges may be waived if you can provide evidence of
financial hardship. You will need to provide a copy of your health care or
pension card in lieu of the application fee.

Before you lodge a formal FOI request, please note that:

* PTV was established on 2 April 2012 and may not hold any relevant
documents/records back to 2008.
* PTV is not the rail safety regulator and is not the most appropriate
agency to deal with requests about rail safety related
data/statistics. Transport Safety Victoria was the relevant rail
safety regulator prior to 19 May 2014. From 19 May 2014 onwards, the
Office of the National Rail Safety Regulator (ONRSR) was the relevant
rail safety regulator.
* Metropolitan electric trains terminate at Pakenham Railway Station and
do not run between Sale and Melbourne (Pakenham Railway Station). All
regional rail services to Gippsland are run by V/Line and depart from
Southern Cross Railway Station (the old Spencer Street Station) and
run along the Pakenham rail line to Pakenham Railway Station where it
then runs on the regional network out to Bairnsdale (the terminus stop
in Gippsland).

Note 1: Mostly I classify a response like this one to say "clarification requested" because the agency has told the applicant that some more information (or money!) is needed before the request will be processed. This time, I have put the response in the category of "refused" because it is several months since the agency responded and the applicant has not made a follow-up. This does not mean that the agency will refuse the request when an application is made in the correct (required).

Note 2: Although an application under the Freedom of Information Act 1983 of the Commonwealth of Australia does not require an application fee, this is not the case with applications in the states and territories of Australia. Then an applicant must usually pay a fee, or the request is not valid. Also, the Commonwealth agencies might demand payment of a fee to cover extra processing costs. If the fee is not paid, the request will not be processed.
