I refer to your request, made under the Freedom of Information Act 1982,
for access to ‘the records of all stolen firearms nationally for the last
5 years. And how and where they were stolen from’.

The most up-to-date, accurate and detailed records in relation to stolen
firearms are held by State and Territory police, which have responsibility
for registering and accounting for firearms. Any information that the
Australian Criminal Intelligence Commission would be able to provide would
have been sourced from a State or Territory, and would not provide a
comprehensive or accurate picture.

That being the case, I invite you to withdraw your request and contact
State and Territory police agencies for the information outlined above.
Should you wish to proceed with your request, a section 26A extension of
time will apply, to allow consultation with State agencies. As such, a
decision would be due to you by Wednesday 19 April 2017.

I would appreciate your confirmation as to whether you wish to withdraw
your request. Should you have any queries, please feel free to contact me
on the details below.

Good morning Mr Whiley

Thank you for your email, from which I understand that you wish to revise
the scope of your original request for access to “the records of all
stolen firearms nationally for the last 5 years. And how and where they
were stolen from” to a request for access to “all of the information at
your disposal  of stolen firearms in Australia”.

Noting that you titled your email ‘Internal review of Freedom of
Information request – Stolen firearms’ I wish to clarify that no decision
has yet been made on your original request for documents. At this point,
it is still open to you to revise your original request so that the
practical refusal reason referred to in my previous correspondence
(attached, for ease of reference) no longer exists.

The practical refusal reason referenced in my previous correspondence is
that the work involved in processing your request in its current form
would substantially and unreasonably divert the resources of the
Australian Criminal Intelligence Commission (ACIC) from its other
operations due to its size and scope. For this practical refusal reason to
no longer exist, you would need to sufficiently narrow the terms of your
original request.

As the scope of your revised request is broader than that of your original
request (no longer date-limited; the new request would include all
documents within scope of the previous request, together with additional
documents) I am of the view that processing your revised request would
substantially and unreasonably divert the resources of the ACIC from its
other operations.

As the ACIC has undertaken work in relation to firearms for many years,
and information the ACIC holds in relation to stolen firearms is primarily
sourced from States and Territories, a further revision of your request in
broad terms is unlikely to enable us to process your request for
documents.

I suggest that you consider reducing the scope of your request to the
following:

“the number of firearms recorded in the Australian Firearms Information
Network (AFIN), the number of firearms recorded in AFIN as stolen, and the
number of firearms recorded in AFIN as lost or missing.”

It is open to you to withdraw your request, make a revised request, or
tell us that you do not wish to revise your request. However, I note that
should you refuse to make a revised request, or revise your request to a
scope which is still too broad to action, we will proceed to a practical
refusal of your request.
