Dear Information and Privacy Commission NSW,
I request documents (statistics) for the previous 7 calender years detailing:
GIIC Act Sect.22
Number of complaints made against agencies
Number of formal investigations undertaken by the Information Commissioner.
Number of formal investigations which found adverse findings against an agency
GIIC Act Sect.23
Number of complaints where there have been found grounds for adverse comment in respect of any person
GIIC Act Sect.24
Number of investigations where a report has been required to be sent to
(a) to the Minister responsible for the agency, and
(b) to the principal officer of the agency, and
(c) where the conduct concerns the conduct of a Public Service employee, to the Secretary of the Department of Premier and Cabinet.

Number of investigations which required entry into the premises of an agency

I am writing to request an internal review of Information and Privacy Commission NSW's handling of my FOI request 'Statistics of the Information Commissioner'.
I am somewhat concerned by the response from Ms Bindner that the IPC does not hold
the information requested.
The GIIC Act gives the Information Commissioner powers for investigations & reviews related
to GIPA Act access applications.
It would seem logical that documents & records associated with those investigations & reviews
would be held by the IPC.
Could you please advise why the IPC would not hold information which is relevant to the
functions performed by the IPC?
Could you please advise what searches were made and what search requests were requested?
Could you please advise who would hold this information?

I write to clarify the previous communication from the IPC with you about
your request for statistics under the GIIC Act.
The IPC does not hold a record a record that provides a summary of the
statistics in respect to specific clauses under the GIIC Act. However, the
IPC does hold records that provide overall complaint statistics which are
also published n it's Annual Report. These statistics provide the number
of complaints and reviews dealt with by the Information and Privacy
Commission. The previous correspondence provided you with links to the
last 7 years Annual Report of the IPC, so that you could obtain this
information. Within these Annual Reports are statistics showing complaints
and reviews undertaken by the IPC by type and sector. I have copied the
most recent statistical table for 2019/20 below to show what records are
available.
However, the IPC does not record when the specific clauses under the GIIC
Act have been invoked, but the total number of cases investigated, how
many days to close cases and the sector the case related to.
