Response to NICNAS Report on MCS research needs

Paul Swain made this Freedom of Information request to Department of Health

This request has been closed to new correspondence from the public body. Contact us if you think it ought be re-opened.

The request was successful.

Dear Department of Health,

In 2010 NICNAS released a report into the research needs of Multiple Chemical Sensitivity:
https://www.nicnas.gov.au/chemical-infor...

Could you please provide me with any information that the Department of Health holds that relates to this report and its recommendations.

Yours faithfully,

Paul Swain

NORMAN, Lewis,

Good morning Paul

NICNAS has received your FOI request for access to the MCS report which
can be accessed here:

[1]http://webarchive.nla.gov.au/gov/2013050...

The Australian Government has endorsed the Web Content Accessibility
Guidelines (WCAG) version 2.0 for all government websites.  The MCS report
was removed as it did not meet these accessibility requirements.

[2]http://webguide.gov.au/accessibility-usa...

I note that NICNAS is currently reviewing old (non-compliant) content with
a view to updating any relevant material in line with WCAG 2.0.

Please let me know if the above information provided in the webarchive
link satisfies your enquiry.

Sincerely

Dear Lewis,

From what I can see, you are responding on behalf of NICNAS. If that is correct, I think that someone has misunderstood my request.

I am not requesting a copy of the NICNAS report - as is clear from my request, I already have access to it at https://www.nicnas.gov.au/chemical-infor... What I want is the Department of Health's response to the report, i.e. any information that the Department of Health holds that relates to this report and its recommendations.

Could you please arrange for the appropriate person to respond to the request that I actually made.

Yours sincerely,

Paul Swain

FOI, Department of Health

Attention: Paul Swain

I refer to your email below to the Department of Health (Health) in which you sought access under the Freedom of Information Act 1982 (FOI Act).

In accordance with section 16(1) of the FOI Act, your request has been transferred from Health to the National Industrial Chemicals Notification and Assessment Scheme (NICNAS) as the subject matter of the documents is more closely related to the functions of that agency. NICNAS has agreed to the transfer.

NICNAS can be contacted by email at [email address].

Dear FOI,

1. Could you please advise which organisation receives this email. I don't have any visibility of that through the Right to Know system.

2. Could you please advise why this request has been transferred to NICNAS. Why would NICNAS hold the information that I have requested.

Yours sincerely,

Paul Swain

NICNAS Info,

Dear Mr Swain

Your email below has been forwarded to NICNAS for response.

1.  The email was received by the Department of Health.

2. Section 16 of the FOI Act states:

16 Transfer of requests

(1) Where a request is made to an agency for access to a document and:

(a) the document is not in the possession of that agency but is, to the
knowledge of that agency, in the possession of another agency; or

(b) the subject-matter of the document is more closely connected with the
function of another agency than with those of the agency to which the
request is made; the agency to which the request is made may, with the
agreement of the other agency, transfer the request to the other agency.

In this case initial consultation with NICNAS by Health revealed that at
least one document within the scope of the request was held by NICNAS
(section 16(1)(a)) and the request relates to a report generated by NICNAS
(16(1)(b)).

I hope this information is of assistance.

Dear NICNAS Info,

Thanks for your response.

Does this mean that the Department of Health will not be searching for any information that it holds that is covered by my request, and that as a consequence, if the Department of Health does hold any information, it will not be provided to me?

Yours sincerely,

Paul Swain

Please Note:The advice provided is general advice in the context of the
ICNA Act only - NICNAS encourages all potential chemical importers to seek
professional legal or other specialist advice to determine their
particular legal obligations under the ICNA Act and also other
State/Territory or Commonwealth legislation which may also be applicable.
Compliance with the obligations of the ICNA Act  does not alleviate the
need to comply with other relevant State/Territory or Commonwealth
legislation
