Dear Mr O'Dea,
I am writing to provide an update in relation to your request for access
to documents under the Freedom of Information Act 1982 (Cth) (FOI Act). I
note that on February 20 2017 you were informed that the processing time
for your request had been extended under s27 of the FOI Act and that a
decision was subsequently due to you on 21 March 2017.
At this stage ASADA is still attempting to finalise its consultation with
the third party involved and hopes to receive a final response from them
in the next few days. With this in mind would you object to the deadline
for a decision being extended to Friday 24 March 2017 under s15AA of the
FOI Act?

Extension of time request under s15AB
On 21 March 2017, the Australian Sports Anti-Doping Authority (ASADA)
requested further time to make a decision on your FOI request of 20
January 2017.
This request was on the basis that the processing period is insufficient
to deal adequately with your request, because it is complex.
I have decided to grant ASADA an extension of time to process your request
to 24 March 2017. This decision has been made under s15AB(2) of the
Freedom of Information Act 1982 (Cth) (the FOI Act).
By granting further time it is anticipated that ASADA will provide a
well-reasoned and better managed decision.

I am writing to request an internal review of Australian Sports Anti-Doping Authority's handling of my FOI request 'Request access to all communications between Minister for Health and ASADA between 23/12/2014 and 13/1/17'.
I note from the documents provided that only 9 of the documents relate to all communications between Minister for Health, Sussan Ley and ASADA (Ben McDevitt) in 2015 and 27 in 2016. There is a gap in any correspondences between the 16th March and the 28th August 2015, followed by a shorter gap between the 29th August and 4th November 2015.
I note that a much publicised trip to WADA Headquarters in Montreal during the first week of May 2015 followed by Mr McDevitt's attendance at a NADOs seminar in Europe have not been included in the 36 documents provided.
I would seek documents relating to reports provided to Minister Ley regarding information on or outcomes achieved from the trips which I believe is within the scope of my original submission

internal review is only available where the decision has not been made by
either the responsible Minister or the principal officer of the agency
(see s54(1) of the FOI Act).
As the decision for which you are seeking review was made by the CEO, the
decision is considered to have been made by the principal officer of
ASADA. Accordingly, the decision cannot be the subject of internal review
under the FOI Act.

To note that to date ASADA provision of information has been restricted to formal letter exchanges. In my view, requests for communication exchanges would extend to records of of communication, electronic, face to face or telephonic. It is standard practice for government agencies to maintain such records. Clearly, that practice was followed by a previous CEO, whose records were made available to the Federal Court
