REPORTS OF MISCONDUCT including failing to follow the Model Litigant Directions by any ATO Prosecutor
Dear Australian Taxation Office,
I apply to access any reports of misconduct by any ATO Prosecutor for failing to adhere to the Model LItigant Directions during the period 01/06/2017 to 14/06/2018.
I make this request as an administrative decision, however should that be unsuccessful I make this request under the Freedom of Information Act.
Yours faithfully,
Keith Owen

Dear FOI,

The decision to refuse this request appears to be misguided.
The Attorney General receives reports on an annual basis and reports on same.
I know I personally made a complaint regarding an ATO prosecutor failing to observe the Model Litigant Directions during the period concerned, so by saying no documents exist, the ATO have admitted that this complaint has not been acted upon!
Yours sincerely,
Keith Owen
Dear Australian Taxation Office,
Please pass this on to the person who conducts Freedom of Information reviews.
I am writing to request an internal review of Australian Taxation Office's handling of my FOI request 'REPORTS OF MISCONDUCT including failing to follow the Model Litigant Directions by any ATO Prosecutor'.
It would appear that at least one substantial complaint has not been reported to the Attorney General's Office regarding a failure to adhere to the Model Litigant Directions. I know this for certain because I've made such a complaint in the timeframe concerned that has evidence to substantiate it!
The responses to these FOI requests have been downloaded and admitted into evidence at the Brisbane Magistrates Court, for a trial being heard on the 25th June.
Strange how the ATO have delayed my request for certain documents, and those same documents were repeatedly requested from the ATO to use in my defence.
A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.righttoknow.org.au/request/r...
Yours faithfully,
Keith Owen

Hi Keith. The ATO has once again lied to the public. A failing to follow the Model Litigant Obligations was submitted by my case officer in Melbourne on 5 May 2018 and subsequently reviewed by Mr N Soares General Counsel on 2 July 2018. I can provide you with a redacted copy if required. Richard.
Dear FOI,
I find it absolutely incredible that the ATO should write a submission to the Senate indicating that it should not be subject to any enforcement regarding the Model LItigant Directions.
Australian Tax Payers can simply not wait for a National Anti Corruption Agency.
Yours sincerely,
Keith Owen
