(NIAA) for access to documents under the Freedom of Information Act 1982
(FOI Act). We confirm the scope of your request as follows:

The NIAA received your request on 22 February 2022 and the 30 day
statutory period for processing your request commenced from the day after
that date. You should therefore expect a decision from us by 24 March
2022.
Charges
Agencies may decide that an applicant is liable to pay a charge in respect
of a request for access to documents. If the decision-maker decides that
you are liable to pay a charge, a preliminary assessment of the charge
will be provided to you as soon as possible.
Publication
Please note that information released under the FOI Act may later be
published online on our Disclosure Log, subject to certain exceptions. If
you think you might wish to raise any objections to the publication of any
of the information which may be released to you, please contact us by

information, you will need to provide supporting reasons.
Information out of scope
The NIAA treats the names and contact details of Commonwealth staff not in
the Senior Executive Service (SES), such as Australian Public Service
(APS) officers, and other personal details of all Commonwealth staff (such
as signatures and direct phone numbers) as not relevant to the scope of a
request. Information that is irrelevant to your request will be excluded
from any documents which may be released to you.
Please note, the NIAA routinely excludes the following from documents
released in response to FOI requests:
• duplicate documents
• duplicate email chains
• publicly available documents, and
• draft or interim documents where a later version is included.

Dear FOI NIAA,
In line with the FOI act and as outlined in your letter I contend that the fee's should not be imposed given that:
1. This request relates to the preparation of advice for an incoming government outside of the official caretaker period (not withstanding the large volume of documents prepared in this period representing a significant diversion of resources).
2. Contents of these documents relate to the officials distinction between policy platforms.
This is obviously in the public interest to both the first nations and wider communities.

Thank you for your email of 19 March 2022.
We advise that the Notice of Estimate of Charge provided to you on 10 March 2022 was a notice pursuant to section 29(1) of the Freedom of Information Act 1982 (Cth) (FOI Act) where the decision maker has provided written notice that you are liable to pay a charge in relation to your FOI request.
Under section 29(1)(f) of the FOI Act, you had 30 calendars days to:
(i) agree to pay the charges;
(ii) contend the charges have been wrongly assessed, or should be reduced or not imposed or both; or
(iii) withdraw your request.
You have contended that the charges should not be imposed (waived) on the basis of public interest.
Under section 29(6) of the FOI Act, the NIAA has 30 calendars to provide you a decision regarding your request for waiver of the charges. Accordingly, a decision is due to on or before 18 April 2022. As this date is a public holiday, section 36(2) of the Acts Interpretation Act 1901 (Cth) allows for the decision to be provided on the next business day, being Tuesday 19 April 2022.
Should you wish to make any further submissions in support of your claim for waiver of the charges, please provide them to the FOI Team via return email by COB Thursday 31 March 2022.
