I refer to your below request under the Freedom of Information Act 1982
(Cth) (‘FOI Act’) on 16 June 2024.
I write to provide an update on the progress of your request. Searches
have been conducted of the Tribunal’s electronic databases and records. No
electronic documents have been located that fall within the scope of your
request. The searches have identified some archived hard copy material
relating to the Kaurna native title claim (SC2000/001). The searches do
not indicate that there are documents within the scope of your request
contained in the hard copy material, however we can retrieve the material
from archives to confirm. It will take some further time in order to
undertake this task.
In addition, I note that in the event that there are documents within the
scope of your request within the hard copy materials, it is likely that
this material will contain personal or other information relating to
extenal parties, and as such, those external parties would need to be
consulted under the provisions of the FOI Act about the release of that
material.
As such, I write to confrim whether you would like to proceed with
searching this material, and if so to seek your consent under s 15AA of
the FOI Act for a further period of 30 days in which to provide a formal
response to your request.
Alternatively, the Tribunal is happy to continue processing your request
administratively, outside of the provisions of the FOI Act. If you are
happy to do so, please respond to withdraw your request as a formal
request under the FOI Act, and we will then continue to retrieve the hard
copy material, search for the documents you seek, and consult with any
external parties as required.

BTW quite a few folk who attended that meeting are now deceased; & other represented corporate bodies may no longer exist, have had name changes, been restructured or merged.

I refer to your below request under the Freedom of Information Act 1982
(Cth) (‘FOI Act’) on 16 June 2024 and further clarified on 12 July 2024.
The Tribunal has now conducted searches of hard copy materials that have
been retrieved from archives. I have attached one document that has been
located, titled ‘Rules for meetings with other native title claimants’ by
way of partial release.
Two other documents have been located which may fall partly within the
scope of the request. Given that these documents contain information
pertaining to a confidential meeting, the Tribunal considers that it is
necessary to consult with third parties prior to making a decision about
whether the relevant information should be released. As such, the Tribunal
proposes to write to the Kaurna Yerti Aboriginal Corporation, as the
relevant registered native title body corporate for the Kaurna Peoples
Native Title Claim, to consult in relation to this information.
Where consultation with a third party occurs, the timeframe for dealing
with a request is extended for 30 days (s 15(6) of the FOI Act). The third
party must also be provided with the eventual decision on whether to
release the documents, and any documents proposed to be released can only
be provided after the third party’s opportunities to review that decision
have run out.
If you would like the Tribunal to proceed with conducting this
consultation, please respond to this email by 9 August 2024.

Seeing as it was not a meeting between other native title claimants i.e. was at a pre-Application stage, the attached Rules pdf does not apply
And I cannot determine wether the other 2 docs vaguely identified as '... partly within scope ...' are worth pursuing without knowing what they relate to.
Can you give me the 2 Document Titles - thereby allowing me to reach a more informed decision?

If my identity remains restricted within this NNTT FOI process & is not shown to third parties: then please proceed & write to Kaurna Yerta.
In regard to Kaurna Yerta's response: is there a requirement for them to provide a valid reason why these NNTT documents may not be released?

released to Kaurna Yerta. For your information however, I note that the
details of your request may be publicly available on the ‘Right to Know’
website that you have used to make the request.
Any submissions provided by Kaurna Yerta would be taken into consideration
by the decision-maker on your request, however the decision as to whether
to release any documents is a decision of the National Native Title
Tribunal and not Kaurna Yerta.
