Sorry for the delay in replying to your latest email.
I contend that the charges of $777 have been wrongly assessed. The Department has an obligation under Part II of the FOI Act to publish operational information under the Information Publication Scheme. An FOI applicant should not bear the costs of the department complying with its legal obligations.
In addition, while I believe the charge has been wrongly assessed, even if had not been I would also contend that the charge should be reduced. The requested information relates to how the Department deals with individuals who owe a debt.
There is extensive public scrutiny around how the Department is publishing requests. The "#robodebt" tag, which is used to refer to the Department's Online Compliance program, has a significant number of stories in relation to alleged debts owed to the Department.
I trust that the Department will be able to consider my contentions and waive the charges associated with this request. If the department would like to discuss the matter further, let me know how we can have a chat on the phone.

Ben - can you please update the state of this request to "refused" - because centrelink wanted you to pay over $700 to do their job.
during my categorisation, there's no option in categorisation to elect "you are too poor to continue with this request" or the requestor things charges are a joke etc - I think the most appropriate option available is "was refused" because the body has put up a wall that for whatever reason, the applicant was unable to go over.
I wish this went to the oaic at the time, "long overdue" is not a correct status for this.
the api_response for this is "waiting_response", which is absolutely incorrect.

I have just been told I have a newstart allowance debt which I think has been wrongly given and maybe some sort of system error. I was on newstart allowance and family tax benefit for my other child, then had a baby so made a claim for parenting payment partnered (it took a long time - roughly 10 weeks I think for the claim to be completed and finalised due to some documents my partner needed) and for them to process it. I started my claim on 11th December.
I received newstart allowance still while waiting until the claim was finalised and my payments switched to the parenting payment which they told me would happen automatically. I then received the overpayment letter which said - We have reassessed your newstart allowance and you were paid more than you were entitled to and will have to pay us back, from the 11th December to the 10th of March you were still receiving newstart allowance, the total amount of your new payments for this period is less than the amount of payments you've already recieved. My payments never changed, they were the same until my parenting payment started, no one told me to wasn't able to receive newstart allowance still, they knew my circumstances. Is it just system error that thinks I was paid the parenting payment from the date I started my claim and sees that I was getting newstart and maybe the system thinks I received both. My parenting payment started on the 10th march. I'm very confused and didn't expect a $3331.89 overpayment out of no where especially after just having a baby.
