Dear Freedom of Information,
I do not agree to the further extension of 6 days proposed because, as you have said, this would have the new due date fall on the public holiday weekend and delay the decision. I agree to a further 4 day extension until Friday 4 October 2024 under s 15AA FOI Act for this request.

Unless the agency applies to the OAIC for an extension of time under section 15AC, the agency is deemed to have refused access to the documents requested. You cannot seek an internal review for deemed decisions.
You could try asking the agency whether they will be seeking a section 15AC extension of time with the OAIC. If they do this, and the OAIC grants them the extension, your right to an internal review gets reinstated.
If not, you have 60 days after the day the decision was deemed to seek an IC Review with the OAIC.
Best of luck
