Dear Jenny Bree
Your Freedom of Information request - Acknowledgement
We refer to your request, received by the Department of Employment and
Workplace Relations (department) on 4 December 2024, for access under the
Freedom of Information Act 1982 (FOI Act) to the following documents:
“… a full unredacted copy of Document 17 of LEX 1114 that appears on the
Department's disclosure Log including the attachments [and] … all
briefings, emails and other communications between your Department and the
Minister between 20 November 2023 to 30 April 2024 relating to draft
principles, short term options and possible future directions around
mutual obligations and compliance.”
Your reference number for this request is LEX 1305. Please include this
reference number in all correspondence relating to your request.
Revision of scope
We are informally notifying you that the work involved in processing your
request in its current form is likely to substantially and unreasonably
divert the resources of the department from its other operations due to
the large number of sensitive documents that appear to be relevant to your
current request.
We recommend that you narrow the scope of your request to ensure that the
department can efficiently process it. You may wish to consider revising
your request to the following:
“all briefings and emails between the Department of Employment and
Workplace Relations and the Minister of Employment and Workplace Relations
from 31 January 2024 to 30 April 2024 relating to draft principles, short
term options and possible future directions of changes to mutual
obligations and compliance policy settings.”
Please let us know by 3pm, Monday 16 December 2024 whether you are
agreeable to revising the scope of your request.
Timeframe
The 30-day statutory period for processing your request commenced from the
day after the department received your request. The 30-day timeframe may
be extended with your agreement or where otherwise permitted under the FOI
Act (for example, if the department is required to undertake third party
consultation).
As the department will be closed from midday 24 December 2023 until 1
January 2024, we are seeking your agreement to a 30-day extension of time
for the department to process your request, pursuant to section 15AA of
the FOI Act. If you agree to this extension the new decision date for your
request will be 3 February 2025. The department will then inform the
Office of the Australian Information Commissioner of the revised due date.
Please let us know by 3pm, Monday 16 December 2024 whether you are
agreeable to an extension.
Charges
The department will advise you if a charge is payable to process your
request and the amount of any such charge as soon as practicable.
Your address
The FOI Act requires that you provide us with an address that we can send
notices to. You have advised your electronic address is
[1][FOI #12469 email]. Unless you tell us
otherwise, we will send all notices and correspondence to this address.
Disclosure log
Information released under the FOI Act may be published on a disclosure
log on our website, subject to certain exceptions. These exceptions
include where publication of personal, business, professional or
commercial information would be unreasonable.
Proposed material that is out of scope
The department will treat any duplicate documents, drafts where there is a
final version available, email chains other than the final versions of the
chains, and documents that are publicly available as out of scope of your
request.
The department will take the above approach when processing your request
unless you tell us otherwise by 3pm, Monday 16 December 2024.
Further assistance
If you have any questions about your request, please email
[2][email address].
Yours sincerely
Marcus

Dear DEWR - FOI,

I am fine with the things you say are out of scope except I would like publicly available information to be included too please.
I also ok with the extension of time, I hope you have a good break.
