Dear Freedom of Information officer Astrid,
Please see the revised terms of my FOI request as per your suggested wording:
‘I am seeking APRA internal documents (including emails), and also any APRA queries to reporting entities, that constitute consideration by APRA of branch classification errors in the authorised deposit-taking institutions points of presence data (also known as ADIPOP) published by the Australian Prudential Regulation Authority (also known as APRA) concerning:
- Bendigo and Adelaide Bank (also known as Bendigo Bank and Rural Bank) and Rabobank; and
- cashless banks (also referred to as tellerless or digital banks) where customers are directed to ATMs for cash rather than being given face-to-face service,
during the period from 11 May 2021 to 19 October 2022 (being the dates from when the errors were first made public to the release of the 2022 ADIPOP data).’
Yours sincerely,
Dale Webster
Dear Astrid (101676),
I do not understand what you require: I revised the FOI request terms as per your suggestions and resent them.
Could you please explain exactly what it is that needs clarification?
Yours sincerely,
Dale Webster

Consultation on Extension of time application by Australian Prudential
Regulation Authority
Dear Ms Webster
I write to advise that on 4 January 2023 the Office of the Australian
Information Commissioner (the OAIC) received an application from
Australian Prudential Regulation Authority (APRA) for an extension of
time, to process your FOI request of 26 December 2022.
APRA has applied for an extension of time under s 15AB of the Freedom of
Information Act 1982 (Cth) because your request is considered to be
complex.
APRA has advised the OAIC that:
o The FOI request was received on a public holiday during the Christmas
shutdown period and the offices re-opened on 3 January 2023.
o The request is complex in nature as it spans many areas within APRA
and many essential stakeholders have had planned time off in January.
o Due to many stakeholders being on leave, it will be difficult to
conduct all the necessary searches required to finalise the FOI
request.
o All stakeholders who are not on leave have completed searches in order
to ensure a decision can be finalised as soon as practicable.
APRA has requested an extension to 24 February 2023. I will take any
comments you may have to make into account when deciding the application.
Please respond to this email by close of business 27 January 2023 or as
soon as practicable. If I do not hear from you by this date, the decision
maker will make a decision on the basis of the information provided to me
by the APRA.
You will be notified of the decision once the matter has been finalised.
Further information about extension of time requests may be found on our
website at [2]Extensions of time.

If you have any questions regarding this email please contact me via email
to [3][email address]. Please quote OAIC reference: RQ23/00035 in all

Dear OAIC - FOI DR,
when APRA contacted me and asked for an extension it gave no explanation for why it could not complete the work in the legislated timeframe so I refused the request.
Had they supplied the information you have provided today I would have happily agreed to an extension, as I did with another department that told me they had staff on leave.
On the basis of the new information I approve the extension.
Regards,
Dale Webster
