Dear Steven
I refer to your email below dated 1 March 2019 in which you have sought
access to documents under the Freedom of Information Act 1982 (the FOI
Act).
Relevant Provisions of the Act
I advise that your request is not valid and I will explain why further
below. I have an obligation pursuant to the FOI Act to assist you in your
application and hope to explain how you can make your request valid.
Your request is invalid for two reasons:
1. First, you have not paid the required fee in the sum
of $28.90 (or requested the fee be waived by reason of hardship and
providing a copy of a valid concession card).
2. Second, your request appears to me to amount to a
request for information rather than documents.
Section 3(1)(b) of the FOI Act, refers to, “…a general
right of access to information in documentary form…” (emphasis added).
Also, section 13 of the Act provides the following (emphasis added):
“Right of access
Subject to this Act, every person has a legally enforceable right to
obtain access in accordance with this Act to—
(a) a document of an agency, other than an exempt document; or
(b) an official document of a Minister, other than an exempt
document.”
Therefore, your request must relate to a specific document or groups of
documents and not information itself.
Next Steps
I would appreciate it if you would respond to the issues raised above
within 28 days of the date of this email, otherwise I will assume that you
do not wish to proceed with your request, and no further action will be
taken by me.
I confirm that unless and until I receive this information, which is
reasonably necessary to enable me to identify the documents you seek, your
request remains invalid, pursuant to section 17 of the FOI Act.

Dear FOI,
The answer is yes
Melton Council is a member of ICLEI, I have the invoice for the membership
The fact that Melton Council avoided answering this question is a cause for concern
I for one do not want to be part of a Council that is evasive and cannot answer simple questions
either Melton council is not a legitimate local government or Melton council is legitimate government sitting in treason ? take your pick ? but don't expect residents to pay rates if you refuse to disclose this type of information to residents.
