FOI, Department of Health

Good afternoon Kath

I am writing to notify you that on 29 May 2024 the Department of Health
and Aged Care (the department) received your request for access to
documents. You have requested:

Please provide all correspondence including briefs, emails, meeting
records and any other documents in the Technology Assessment and Access
Division about the waitlist for the Insulin Pump Program since 1 July
2023.

The relevant business area has conducted preliminary search and advised
that in its current form your request would likely capture a large number
of documents. It is likely that the work involved in processing your
request in its current form would substantially and unreasonably divert
the resources of the department from its other operations due to its
extremely broad scope. This may constitute a ‘practical refusal reason’
under section 24AA of the FOI Act.

On this basis, you may wish to revise the scope of your request to the
document ‘Performance Reports and correspondence from the IPP
administrator that contains waitlist data since 1 July 2023’.

Would you please advise if you wish to revise your FOI request as
proposed. We would appreciate your response by COB Monday 17 June 2023.

Kind Regards,

Dear Kath,

I refer to your request 5165.

We thank you for your ongoing patience and cooperation as we continue to
process your request and will endeavour to finalise it as soon as
possible.

The statutory due date for your request is currently 7 August 2024.

Request for extension of time

Section 15AA of the FOI Act permits the department to extend the
statutory processing timeframe, with your agreement, for a period of up to
30 calendar days.

The department has identified in scope documents containing information
about a third party and considers it would be appropriate to consult with
that third party under section 27 of the FOI Act. To ensure the department
takes all relevant steps to finalise its decision and for the decision
maker to make a well-balanced decision on access to documents identified,
the department is seeking your agreement to an extension of 20 calendar
days.

If you agree to this extension, the statutory due date will then be 27
August 2024. The department will, however, continue to process your
request as quickly as possible.

It would assist if you could please advise by Friday 2 August 2024 if you
agree to this extension of time. If we do not hear from you by this date
or if you do not agree to the extension, the department may consider
seeking an extension of time from the Office of the Australian Information
Commissioner (OAIC) under section 15AB of the FOI Act.

If you have any questions regarding any of the matters discussed in this
email, please do not hesitate to contact the FOI Section.

Kind Regards,
