I refer to your below email received on 1 June 2021 in response to the
decision of FOI 20/21-0628.
On 7 May 2021, in response to the formal 24AB consultation process, you
revised the scope of the second part of your request to the following:
“...a list of all staff employed within the Agency's new Sustainability
Action Taskforce, as well as any correspondence that relates to terms of
reference or scope of the Taskforce
a lpist [sic] of any contractors who have been outsourced in the
development of an algorithm for the NDIS' and 'please also provide a copy
of any reports that proposed using Salesforce/developing new algorithms in
relation to scheme sustainability (including outsourced reports and
business cases, as well as modelling [sic]), as well as details of the
tender documentation and conditions of tender between the NDIA and the
developers of the algorithm”
As outlined in the decision letter, it was determined that responding to
your revised scope would be a substantial and unreasonable diversion of
resources. I can advise that searches in relation to part 1 of your scope
returned thousands of documents that referenced the Sustainability Action
Taskforce and “terms of reference” and/or “scope”.
I can also advise that applicants are not able to vary the scope of their
requests as part of an internal review. Under the internal review
mechanism, the original decision is reconsidered to determine whether it
was correct.
In your email below you have stated that you are “prepared to just accept
the list of staff as well as the actual terms of reference and
correspondence directed to or from the CEO of the agency regarding setting
up the Taskforce”.
Given scopes are unable to be changed as part of internal reviews, would
you prefer to withdraw your request for a review and instead make a new
request with the following scope:
1. A list of the staff working in the Sustainability Action Taskforce
2. The final terms of reference for the Sustainability Action Taskforce
3. Correspondence directed to or from the NDIA CEO regarding setting up
the Sustainability Action Taskforce
If you would like to proceed with making a new request, we will take the
day of your agreement as the start date of your request.
Please let us know by reply email whether you consent to withdraw your
internal review and make a new request by 5:00pm 14 June 2021.
