Housing Register - Unmet benchmark between Launceston and Hobart

Dear Homes Tasmania,

Under the assistance statutes of Right To Information ("RTI")

Please let me know if there is statistics available that would enable quantitive analysis to benchmark between local councils e.g. between Launceston and Hobart to do comparitative statistical analysis how the councils perform at local level?

I understand that you publish the monthly dashboard but was wondering whether there is categorisation available to benchmark councils.

Under the Right to Information Act 2009 (the Act) an applicant needs to comply with the regulations of the Act.

Section 5 - Minimum information to be contained in application for assess disclosure states that:

For the purposes of section 13(3) of the Act, the following information is prescribed as the minimum information that must be contained in an application for assessed disclosure of information under that section:
(a) the name of the applicant

In addition to this if you are seeking to have the fees waived because you are impecunious you are required to provide evidence of your income, such as Health Care Card. This would also provide proof of your identity.

I have attached Homes Tasmania's Right to Information application form for you to complete. We are happy to consider your requests but require basic details. Please let me know if you have any further questions.

The section says nothing about government attestation of one's identity.

The name was below the signature line and you are not able to impose arbitrary requirements.

The names is included and there is no leglislation what so ever that it needs to be as such.

Dear Miss Anonymous

I refer to your below email of 31 July 2024, in which you enquire about information held by Homes Tasmania.

In your email, you make the following request, "Please let me know if there is statistics available that would enable quantitive analysis to benchmark between local councils e.g. between Launceston and Hobart to do comparitative statistical analysis how the councils perform at local level? I understand that you publish the monthly dashboard but was wondering whether there is categorisation available to benchmark councils."

In accordance with s13(8) Right to Information Act 2009 (Tas) (the Act), I confirm that Homes Tasmania does not collect or retain information that could benchmark data for councils.

If you wish to make application to Homes Tasmania to access information in accordance with the Act, I encourage you to complete the Homes Tasmania Right to Information application form, which my colleague provided to you by way of email on 2 August 2024.

I confirm my colleague's advice to you that s13(3) of the Act requires that applications contain minimum information, including the applicant's name. The minimum information to be provided is set out in regulation 5 of the Right to Information Regulations 2021 (Tas), which I have reproduced below for your convenience.

Minimum information to be contained in application for assessed disclosure
For the purposes of section 13(3) of the Act, the following information is prescribed as the minimum information that must be contained in an application for assessed disclosure of information under that section:
(a) the name of the applicant;
(b) a postal address, or email address, for the applicant, to be used for communication on matters relating to the application;
(c) the contact details of the applicant where the applicant may be contacted during ordinary business hours;
(d) the general subject matter of the application;
(e) details of the information sought by the applicant under the application, including all relevant dates and time periods that may relate to the information being sought, if known by the applicant;
(f) details of efforts undertaken by the applicant, if any, before the application was made, to obtain from publicly available sources the information sought;
(g) the date on which the application was signed by the applicant;
(h) if the application includes a request for personal information of the applicant, proof of identity of the applicant.

I confirm that any application must also be accompanied with payment of the application fee which is $46.75. As my colleague has advised, you may seek a waiver of the fee on the basis of impecuniosity, in which case you will be required to provide evidence of your impecuniosity such as your income or health care card. The other grounds for seeking a waiver are if you a Member of Parliament or journalist acting in connection with your duties, or if you are able to show that you intend to use the information for a purpose that is of general public interest or benefit. In all cases, we will require evidence to support your request for a waiver of the application fee.
