Freedom of Information request - Staff Complaints
Dear Australian Broadcasting Corporation,
Consistent with section 17 of the Freedom of Information Act, I am seeking a document to be created and provided by the Corporation that includes.
The number of bullying or harassment complaints submitted by staff or contractors between the years 2011 and 2021.
I ask that the figures be broken down by city in which the complainant was based, and by calendar year.
Yours,
NRP

Dear Not Rex Patrick
The ABC refers to your request for a document to be created that shows:
"The number of bullying or harassment complaints submitted by staff or contractors between the years 2011 and 2021.
I ask that the figures be broken down by city in which the complainant was based, and by calendar year."
The ABC does not have data back to 2011. We will get back to you shortly about what parameters would be able to be utlised for a document to be created for you under s 17 of the FOI Act.
Many thanks, FOI team

Dear Not Rex Patrick
The ABC confirms that we are able to create a document that contains data from calendar years 2011 to 2021 inclusive.
Due to our Christmas shutdown period, the ABC would be grateful if you would agree an extension of time under s 15AA of the Freedom of Information Act (Cth) 1982 (the FOI Act) so we can finalise your request when relevant staff are available.
A maximum of 30 days can be agreed under s 15AA which would make the decision due by Monday 30 January 2023. The ABC would endeavour to issue the decision to you before this date.
Would you kindly respond by email by tomorrow as to whether you may agree to this extension of time? We note the Right to Know site shows that you may not have read our email of 13 December. Would you kindly confirm you are contactable at this email address?
Many thanks,
FOI team

Dear NRP
Thank you for your email.
Would you kindly let us know if you are happy to agree this scope of request:

Dear FOI Team,
Thank you for your email. I'd be happy to amend the request to the following, noting that ABC Staff and contractors are also outside of Australia.
'A document that shows the number of bullying or harassment complaints submitted by ABC staff or contractors between 2011 and 2021 by calendar year, broken down by the state or territory in Australia in which the complainant was based, and by country where the complainant was based if they were outside of Australia.'
Please let me know if there are further questions on how to process this request.
Yours,
NPR
Thank you for your email.
The ABC is not able to facilitate this portion of your amended request: "and by country where the complainant was based if they were outside of Australia."
We note you have asked for a document to be created for you under s 17 of the FOI Act. Pls confirm whether you are happy to proceed on this basis as this is the information the ABC can prepare for you:
A document that shows the number of bullying or harassment complaints submitted by ABC staff or contractors between 2011 and 2021, broken down by the state or territory in Australia in which the complainant was based and by calendar year.
We are available by phone if you would like to discuss.
Many thanks,

Dear FOI Team,
Thank you for the clarification. Could I confirm you're not able to facilitate that portion because you don't hold the data or because the request would be too broad?

Good afternoon NRP
On 29 November 2022 you asked for a document that did not exist to be created for you.
The ABC has attempted to assist you and agree a scope of request. If you would like to have a conversation about that, or have questions, please phone us.
If you would like to proceed with the scope emailed to you on 24 January 2023, please confirm by email. Until such time, this file is suspended as our attempts to assist you have not been successful.
Many thanks,
