FOI, National Library of Australia

Dear Mr Frankaland

Thank you for your request for documents below. In accordance with subsection 15(5)(a) of the Freedom of Information Act 1982, I confirm receipt of your request.

For reasons given previously in response to your FOI request of 12 December, namely that:

- The public service shutdown between 25 December 2021 and 3 January 2022;
- As you know, the National Library is a small agency with limited resources and I am the only FOI officer. In addition to the shutdown period, I am currently on leave and will not return to the office until 3 January 2022;

from today until 3 January, the Library does not have any other resources to respond to you. Please note that as I am on leave as of today, I will not be able to consider your current request of 17 December until I return to the office on 3 January 2022. For that reason, it is likely that we may need to request an extension for this request also.

Kind regards
Angie

FOI, National Library of Australia

Dear Mr Frankaland

As indicated previously, I request that you agree to an extension of 30 days for the decision making period, making the statutory due date of the decision in response to this request 15 February 2022.

As indicated previously, this is to take into account:
- The public service shutdown between 25 December 2021 and 3 January 2022.
- As you know, the National Library is a small agency with limited resources and I am the only FOI officer, and I was on leave between 20 December 2021 and 3 January 2022.

Taking the above into account in calculating the number of days until the usual statutory deadline of 16 January 2022, there would only be 13 days, which is just over a third of the usual statutory decision period of 30 days.

Please confirm by return email that you agree to the extension by COB this Friday, 14 January 2022.

Kind regards
Angie

Dear Mr Frankaland

This is in relation to the documents we provided in response to your FOI request below. Please disregard the documents that were provided as they contain some personal information that were intended to be redacted - apologies for the oversight. Grateful if you could please delete and/or destroy all copies of those documents and consider the documents attached to this email to be provided under the FOI Act instead.

Further, we have just now realised that two emails from you regarding extension of this request (14 January 2022 and 24 January 2022) that are shown on the Right to Know website (https://www.righttoknow.org.au/request/f...) were not received by our FOI inbox. Apologies for the confusion this may have caused.

Kind regards
Angie

Subject: CM: RE: Freedom of Information request - Feedback received for username r.j.trenwith

Dear Mr Frankaland

This is in relation to your FOI request of 17 December 2021. You requested all documents in relation to feedback from the public received since November 17, 2021 regarding Trove username r.j.trenwith.

Please see attached documents that fall within the scope of your request.

The relevant documents falling within the scope of your request contain personal information of members of the public. Documents or parts of documents containing personal information are exempt from disclosure under the FOI Act in certain circumstances. In this case:

• the relevant personal information is not well known and does not appear to be available from public sources • the person(s) to whom the information relates may be known to be associated with the matters dealt with in the document • enquiries received by the Library in the past in relation to Trove indicate a concern of harassment within the relevant sector of the community • the release of the personal information would not further promote objects of the FOI Act (e.g. increased scrutiny of Government activities), which is supported by release of the remaining information in the relevant documents.

Under section 47F of the FOI Act, the Library has therefore made the decision to redact certain personal information (including information that can reasonably identify an individual) contained in these documents, on account of that information being determined as conditionally exempt. This is because the disclosure of that information would involve the unreasonable disclosure of personal information (subsection 47F(2)). Personal information that has been redacted include names and contact details. Where personal information has been redacted, wherever permitted by technology, the text ‘[name redacted]’ or similar will appear to indicate what type of personal information has been redacted, or the text will simply be redacted.

Please note that names of Library staff members who are below the SES level have been redacted from the documents in accordance with section 22 of the FOI Act, for the reason that:
• these names are reasonably regarded as irrelevant to the request, and • it is not apparent you would decline access to the edited copy of the documents.

Where Library staff names have been redacted, the text ‘[staff name redacted]’ will appear to indicate this.

Kind regards
Angie
