I refer to the letter from Mr Ben Vallence, Acting General Counsel, dated 31 August 2016.
Please carry out an internal review of the decision to refuse access to the documents on the grounds that the documents do not exist.
In accordance with paragraph 11.1(ba) of the Legal Service Directions 2005, FWBC is responsible for ensuring that the agency's legal services purchasing, including expenditure, is appropriately recorded and monitored.
In circumstances where the Acting General Counsel of FWBC has determined that documents containing the costs of external legal services arising out of or connected with legal proceeding file number BRG21/2016 against the Director of FWBC do not exist, FWBC has failed to record and monitor legal services purchasing and expenditure in contravention of paragraph 11.1(ba) of the Legal Services Directions 2005.
