Extension of time application by Australian Federal Police
Dear Ms Verbatim
I write to advise that on 17 November 2021, the Office of the Australian
Information Commissioner (the OAIC) received an application from the
Australian Federal Police (the AFP) for an extension of time, to process
your FOI request of 22 September 2021.
The AFP has applied for an extension of time under s 15AB of the Freedom
of Information Act 1982 (Cth) because your request is considered to be
voluminous and/or complex.
The AFP has advised the OAIC that:
o the AFP sought your agreement to an extension if time under s 15AA of
the FOI Act, however a response has not been received
o the statutory processing period was extended to conduct third party
consultations under s 15(6) of the FOI Act
o given the broad terms of the request, the relevant area of the AFP
identified a significant volume of material such that assistance from
AFP IT was required to transfer the information to the FOI Team
o in addition to the volume of material, the nature and content of the
material is also complex. The material features significant amounts of
personal and business information, and
o the AFP requires further time to finalise its considerations of the
relevant documents and provide a decision.
The AFP has requested an extension to 22 December 2021. The decision
maker will take any comments you may have to make into account when
deciding the application.
Please respond to this email by close of business 24 November 2021. If I
do not hear from you by this date, the decision maker will proceed to make
a decision on the basis of the information provided to the OAIC by the
AFP.
You will be notified of the decision once the matter has been finalised.
Further information about extension of time requests may be found on our
website at [1]Extensions of time.

Dear Ms Verbatim,
We refer to your Freedom of Information request made to the AFP in the
above matter and our below correspondence.
As noted in our email dated 29 September 2021, the terms of your request
are broad and are not specific enough to enable the AFP to efficiently
search its records. Further, as it currently stands, the terms of your
request capture a significant volume of material such that a practical
refusal reason exists pursuant to section 24AA(1)(a)(i).
The AFP has made multiple attempts to contact you, however to date we have
yet to receive a response.
Accordingly, please see attached letter giving notice under section
24AB(2) of the Freedom of Information Act 1982 of an intention to refuse
to grant access
We note that pursuant to section 24AB you have 14 days upon being given
notice to contact the AFP to revise the request so that a practical
refusal reason no longer exists. Accordingly we require a response from
you by Monday 3 January 2021. Given the AFP’s upcoming Christmas shutdown
period, we ask that you please also consider agreeing to the 30 day 15AA
extension of time requested in our email dated 12 October 2021.
Kind regards,
SAM (AFP 24650)
