Dear Susan Taylor,

I may not be as informed as yourself in the nuances of the FOI Act but I find it puzzling that you have chosen to delay my request to consult with a third party about release of these documents. It was my understanding that as the government appointed anti-doping agency for Australia, ASADA performed their duties without prejudice, fear or favour in the interest of sport and the Australian Public which includes our athletes.

The information I have requested would be used, I contend, to indicate the performance of ASADA year to year across all WADA signatory sports. My request does not seek identification of individuals. It is high level data with no in-depth detail.

Is it possible to indicate who this third party might be? If the third party is another Government Agency I have some acceptance of due process but it is easy to identify that the third party may be the very sporting organisation named in my request which does concern me, and I would suggest, many others.

Please find attached ASADA's response to your FOI request.

 

Your request for access to documents relating to AFL drug tests was
received on 24 March 2017.

Specifically you sought access to:

• lists or equivalent documents that detail the number of AFL players
tested by ASADA,
the number of tests performed, the dates those samples were taken and
categorised by club
for the AFL seasons between 2004 and 2016.

An acknowledgment of your request was sent to you via email on 10 April
2017. That correspondence informed
you that a decision was due to be made by Monday 24 April 2017.
Under the terms of sections 27 and 15(6) of the FOI Act this deadline was
extended to allow for consultation with
a potentially affected third party. The deadline for a decision was
therefore extended to Wednesday 24 May 2017.
