Correction to FOI 24.24 0322 - Access Decision Timeframes (FY 2023-24 Q3 and Q4)

This request has been withdrawn by the person who made it. There may be an explanation in the correspondence below.

Dear National Disability Insurance Agency,

I request access to this information under the Freedom of Information Act.

Please provide the following figures for these quarters:

• FY 2023-24 Q3 (1 January 2024 – 31 March 2024)
• FY 2023-24 Q4 (1 April 2024 – 30 June 2024)

4. The total number of access decisions or requests for more information
made during the quarter, after more information had been provided, and;

a). The number of those decisions/requests made within 14 days of
receiving the additional information.

b). The number of those decisions/requests made within 15 to 40 days of
receiving the additional information.

c). The number of those decisions/requests made within 41 to 104 days of
receiving the additional information.

d). The number of those decisions/requests made 105 or more days after
receiving the additional information.

--------------------

This request is to correct the issue found in the FOI 24.25 0322 decision document. For point 4 I had requested the timeframe ranges to be "within 14 days, 15 to 40 days, 41 to 104 days, and 105 days or more". But I was instead incorrectly provided with figures for the ranges associated with the prior question, point 3, which were "within 21 days, 22 to 60 days, 61 to 111 days, 112 days or more".

Please process this correction as a new freedom of information request.

Yours faithfully,

Stuart

Dear Stuart

Freedom of Information Request: Acknowledgement

Thank you for your request of 5 February 2025, made under the Freedom of
Information Act 1982 (FOI Act), for information held by the National
Disability Insurance Agency (NDIA).

Scope of your Request

You have requested access to:

“…Please provide the following figures for these quarters:

• FY 2023-24 Q3 (1 January 2024 – 31 March 2024)

• FY 2023-24 Q4 (1 April 2024 – 30 June 2024)

4. The total number of access decisions or requests for more
information
made during the quarter, after more information had been
provided, and;

a). The number of those decisions/requests made within 14 days
of
receiving the additional information.

b). The number of those decisions/requests made within 15 to 40 days
of
receiving the additional information.

c). The number of those decisions/requests made within 41 to 104 days
of
receiving the additional information.

d). The number of those decisions/requests made 105 or more days
after
receiving the additional information…”

Processing Timeframes

In accordance with section 15(5)(b) of the FOI Act, a 30-day statutory
period for processing your request commenced from 6 February 2025. This
30-day period expires on 8 March 2025.

The 30-day period can be extended in a number of ways, including with your
agreement.

Unfortunately, it is currently taking us a little longer than 30 days to
process FOI requests due to a very high volume. I am therefore seeking
your agreement to a 30-day extension of time under section 15AA of the FOI
Act. If you agree to this extension, the new due date for us to decide on
your request will be 7 April 2025.

If you do not agree and we are unable to process your request within the
30-day period, we will be deemed to have refused your request and you will
not have a right to seek internal review of that decision. You will,
however, retain your right to external review by the Australian
Information Commissioner.

Please let us know if you agree by Tuesday 11 February 2025.

Irrelevant Information

Section 22 of the FOI Act allows an Agency to redact information from
documents if that information would reasonably be regarded as irrelevant
to a request for access.

Given the nature of your request, it does not seem that NDIA staff
members’ surnames and contact details would be relevant to you. Can you
please send me a reply email confirming that such details are irrelevant
to your request for access?

Disclosure Log

Subject to certain exceptions, documents released under the FOI Act will
be published on the NDIA’s disclosure log located on our website.

If you have any concerns about the publication of the documents you have
requested, please contact me.

Next steps

Your request will be allocated to an authorised FOI decision-maker. The
decision-maker may need to contact you to discuss a range of matters,
including refining the scope of your request.

We will contact you using the email address you have provided. Please
advise if you would prefer us to use an alternative means of contact.

In the meantime, if you have any questions or need help, please contact us
at [1][NDIA request email].

Regards
