Minister/Minister's office and the Australian Conservation Foundation
(ACF) and its representatives between the period 1 July 2024 and 18

We refer to your Freedom of Information request seeking documents in the
possession of the Minister for the Environment and Water (Minister’s
Office) regarding correspondence between MO Plibersek the Australian
Conservation Foundation , LEX 79126.

The Minister’s Office is working to respond to your request and a decision
for this request is currently due on 20 January 2025.

The processing time for this request has been impacted by the recent
Christmas/New year shut down period (25 December 2024 to 1 January 2025
inclusive).

During this time, the Minister’s Office and the Department of Climate
Change, Energy, the Environment and Water (DCCEEW) did not operate and
were not able to process FOI requests. In addition, following the recent
shutdown period and until approximately mid-late January, there will be
limited staff available to process FOI requests due to staff taking
recreational leave. The impact of the shutdown period and the limited
staff available during this time of year affect the Minister’s office /
department’s ability to process this request within the statutory
timeframe.

Accordingly, we would be grateful if you would provide the Minister’s
Office with an extension for processing this matter. We are seeking under
s 15AA of the FOI Act to extend the statutory deadline for your request
for an additional 14 days, to 3 February 2025.

It would be appreciated if you could please consider this extension
request and confirm, via reply email, by COB tomorrow 14 January 2025,
your agreement to a 14-day extension.

Your Freedom of Information request – Third Party Consultation - LEX 79126

 

We refer to your request received by the Office of the Hon Tanya Plibersek
MP, Minister for the Environment and Water (Minister’s Office) on 20
December 2024 for access to documents under the Freedom of Information Act
1982 (FOI Act) made in the following terms:

 

‘Under the FOI Act, I am seeking copies of all communication between the
Minister/Minister's office and the Australian Conservation Foundation
(ACF) and its representatives between the period 1 July 2024 and 18
December 2024.’

 

Third party consultation – documents affecting personal privacy and
business

 

Your request covers documents which may contain personal information of
identifiable individuals as well as documents related that may be the
business and/or professional affairs of third parties.

 

The Minister’s Office is required to consult with those individuals and
entities under sections 27 and 27A of the FOI Act before making a decision
on the release of those documents. 

 

The consultation mechanism under these sections applies when the
department considers the individual whose personal information in
contained in a document may wish to contend that the requested documents
are exempt for reasons of personal privacy and/or the department considers
the person or organisation concerned may wish to contend that the
requested documents contain business or financial affairs and are exempt
from disclosure under the FOI Act. 

 

The Minister’s Office will take into account any comments received from
the relevant individuals/organisations.  However, the final decision about
whether to grant you access to the documents you requested rests with the
FOI delegate in the Minister’s Office. 

 

Time limits for processing your request

 

Under section 15(6) of the FOI Act, the period for processing your request
has been extended by 30 days to allow the Minister’s Office time to
consult with the relevant third parties. Accordingly, you can now expect a
decision on 18 February 2025.
