Your Freedom of Information request – consultation
I refer to your request, dated and received by the Office of the Hon Tanya Plibersek MP (
Minister’s
Office) on 20 December 2024, for access under
the Freedom of Information Act 1982 (Cth) (
FOI Act)
to the following documents:
‘Under the FOI Act, I am seeking copies of all communication between the
Minister/Minister's office and the Australian Conservation Foundation (ACF) and its
representatives between the period 1 July 2024 and 18 December 2024.’
Your request involves significant resources for the Minister’s Office
Due to the amount of work involved for the Minister’s Office, under sections 24AA(1)(a)(ii), 24 and
24AA(2) of the FOI Act, the Minister’s Office intends to refuse your FOI request as a 'practical refusal
reason' exists. Under the FOI Act, the practical refusal reason is that processing your request 'would
substantially and unreasonably interfere’ with the performance of the functions of the Minister’s
Office.
To process your request, the Minister’s Office would have to do extensive searches to find and
process the documents you have requested. Preliminary searches indicate that the Minister’s Office
hold more than 480 documents. This is a conservative estimate, and we estimate it would take
approximately 70 hours to process your request. In addition, the Minister’s Office would also be
required to consult with at least one third party as mandated by the FOI Act.
This estimate does not include the actual processing time required for locating and collation of all
documents or identifying the number of pages per document. Estimates relating to the above
cannot be determined at this time without viewing the content of each document.
As you have sought access to all ‘communications’ which includes emails this request has captured a
significant number of documents.
If you decide not to make any revisions to your request, the department may refuse your FOI
request as a ‘practical refusal reason’ exists.

How to send us a ‘revised request’
Before a final decision is made on your request, you can submit a revised request.
Within the next 14 days (consultation period) you must do one of the following in writing:
• withdraw the request;
• make a revised request; or
• tell us that you do not want to revise your request.
If you do not contact us during the consultation period, your request will be taken as having been
withdrawn.
If you would like to make a revised request, it is suggested you consider both of the following
suggestions:
• narrowing the request to a specific subject matter; and
• narrowing the date range for the documents sought.
