Complaint and Summons - AFP Member as the Complainant?
Dear Australian Federal Police,
In Criminal matters that are started by way of Complaint and Summons, how is it that the AFP Member becomes the Complainant rather than informant and why is the matter not prosecuted in the name of the Crown?.
Yours faithfully,
Sam
OFFICIAL
Dear Sam
I refer to your below request to the Australian Federal Police (AFP).
Your request in its current format, does not meet the requirements of the
Freedom of Information Act 1982 (Cth) (FOI Act).
Section 15 of the FOI Act requires that a request for access meets certain
requirements. A Freedom of Information (FOI) request must:
• state that the request is an application for purposes of the FOI Act;
• provide sufficient information about the document(s) to allow us to
process the request; and
• provide an address for reply.
The FOI Act provides a mechanism for individuals to access ‘documents’
held by entities such as the agency. At present, you have not specified
what documents you are seeking, nor provided sufficient information to
enable us to locate documents responsive to your queries. If you are able
to provide further clarification on the documents you are seeking, this
will assist in searches to be conducted.
Further information about how to apply for your FOI is available on our
website: [1]https://www.afp.gov.au/about-us/freedom-...
The AFP will not be undertaking any further action in regards to your
request until we receive a response from you.
Kind regards
FREEDOM OF INFORMATION
