Dear Tymeka Murray

 

I refer to your email dated 20 February 2015, received by the Department
of the Prime Minister and Cabinet (PM&C), in which you made a request to
the Department under the Freedom of Information Act 1982 (the FOI Act) in
the following terms:

 

I wish to have any documents relating to the changes in immigration laws
due to recent terrorist plots around the country.

 

I am writing to tell you that PM&C has transferred your request to the
Department of Immigration and Border Protection (DIBP). Under section
16(1) of the FOI Act an agency is able to transfer a request if the
subject matter of the document requested is more closely connected with
the functions of another agency. Accordingly, on 23 February 2015 PM&C
transferred your request to DIBP, whose functions are more closely
connected to the subject matter of the documents you have requested. DIBP
will continue to process your request.

 

PM&C received your request on 20 February 2015 and the 30 day statutory
period for processing your request commenced from the day after that date.
DIBP will treat your request as though it received it the same day that
PM&C did. You should therefore expect a decision from DIBP by 22 March
2015. The period of 30 days may be extended if DIBP needs to consult third
parties or for other reasons. They will advise you if this happens.

Purpose of this email

I am writing to you about the s.24AB notice that I sent to you on
Wednesday 25 February 2015. The consultation period under the FOI Act
expired at close of business on Wednesday 11 March 2015. As you did not
respond to me by the end of the consultation period, your request is
deemed to have been withdrawn by the operation of the FOI Act (s.24AB (6)
and (7)).
