Cases from Member Hugh Sanderson involving China’s handling of the COVID-19 pandemic

The request was partially successful.

Dear Administrative Appeals Tribunal,

From 16 October 2019 to 16 October 2020 (inclusive), how many Tribunal cases involved Tribunal Member Hugh Sanderson considering how effective the Chinese authorities were in being able to control the spread of the COVID-19 virus in China and ensure all Chinese citizens received appropriate medical treatment?

Yours faithfully,

OFFICIAL

Dear Thomas,

I have liaised with the Tribunal's Data, Performance and Insights team regarding your FOI request.

They have informed me that they do not hold any readily available data for cases profiled in the manner in which you have described. They have said that they may be able to provide for you a count of cases decided by the Member for the period where the Country of reference was China, however they cannot narrow it down to just those where COVID-19 virus conditions were considered without manually reviewing each decision which may constitute an unreasonable diversion of resources.

Could you please reply whether you agree to the revision of the scope of your request to be 'a count of cases decided by Tribunal Member Hugh Sanderson'? Alternatively, if you would like to withdraw your request please reply in writing that you withdraw your request.

If you have any questions about this, please do not hesitate to contact me on the below details. Otherwise, I look forward to your response as soon as possible.

Kind regards,

Jodie C

Dear Thomas,

Thank you for your reply email.

I have relayed your revised FOI request to the Tribunal's Data,
Performance and Insights team. Given that the decision for your FOI
request is due on 15 November 2024 to enable me to process your revised
request I would be grateful if you could you please agree to an extension
of time.

Under section 15AA of the FOI Act, we may extend the 30 day processing
period if you agree in writing to that extension. Due to the time needed
to search, collate and review the document, as well as liaise with the
other section of the Tribunal, I would like to request for an extension of
9 days to process your FOI requests. This would extend the processing time
for your FOI request to Monday 25 November 2024. I will of course
endeavour to provide a decision on this FOI request before this date, if
possible.

I would be grateful if you could confirm your agreement to this extension
of time by way of return email as soon as possible.

Kind regards,
